IN-CONTEXT TRANSLATIONS

Article 2(2)(b)(i) of Council Directive 2008/78/EC of 27 November 2000 establishing a general framework for equal treatment in employment and occupation must be interpreted as precluding national legislation under which an employer may dismiss a worker on the grounds of his intermittent absences from work, even if justified, in a situation where those absences are the consequence of sickness attributable to a disability suffered by that worker, unless that legislation, while pursuing the legitimate aim of combating absenteeism, does not go beyond what is necessary in order to achieve that aim, which is a matter for the referring court to assess.

14. Section 3 does not apply to supplies of arms and related material or technical assistance intended solely for the purpose of helping develop security sector institutions, consistent with the political process set out in paragraphs 1 to 3 of Security Council Resolution 1744 and in paragraphs 1 to 5 of Security Council Resolution 1772, and in the absence of a negative decision by the Committee of the Security Council in conformity with Security Council Resolution 1744 and Security Council Resolution 1772.

(2) In the event of the absence or incapacity of a commissioner other than the Chairperson or Vice-Chairperson or if the office is vacant, the Governor in Council may designate a person to act as a commissioner for the period of the absence, incapacity or vacancy and the person so designated has and may exercise all the powers and perform all the duties and functions of a commissioner, unless the Governor in Council specifies otherwise.

161. In the event of the absence or incapacity of the Correctional Investigator, or if the office of Correctional Investigator is vacant, the Governor in Council may appoint another qualified person to hold office instead of the Correctional Investigator during the absence, incapacity or vacancy, and that person shall, while holding that office, have the same function as and all of the powers and duties of the Correctional Investigator under this Part and be paid such salary or other remuneration and expenses as may be fixed by the Governor in Council.

The new provision respecting leaves of absence without pay, which is designed to address cases such as the one of Madam Justice Arbour, where a judge has been invited to participate in the work of an international organization of states or an institution of such an organization, requires a leave of absence of at least six month's duration and the approval of the Governor in council, after consultation with the chairman of the Canadian Judicial Council.

In line with the high dependence of the Azores on milk production, combined with other handicaps connected with their distant location and the absence of profitable alternative lines of production, the derogation from certain provisions of Council Regulation (EC) No 1788/2003 of 29 September 2003 establishing a levy in the milk and milk products sector , introduced by Article 23 of Council Regulation (EC) No 1453/2001 of 28 June 2001 introducing specific measures for certain agricultural products for the Azores and Madeira (Poseima) and renewed by Council Regulation (EC) No 55/2004 should be confirmed with respect to the application of the supplementary levy in the milk and milk products sector in the Azores.
Afin de tenir compte de la forte dépendance des Açores vis-à-vis de la production laitière, à laquelle s’ajoutent d’autres handicaps liés à leur ultrapériphéricité et l’absence d’une production de remplacement rentable, il est nécessaire de confirmer la dérogation qui avait été faite à certaines dispositions du règlement (CE) no 1788/2003 du Conseil du 29 septembre 2003 établissant un prélèvement dans le secteur du lait et des produits laitiers , introduite par l’article 23 du règlement (CE) no 1453/2001 du Conseil du 28 juin 2001 portant mesures spécifiques concernant certains produits agricoles en faveur des Açores et de Madère (Poseima) et prolongée par le règlement (CE) no 55/2004 du Conseil en ce qui concerne l’application du prélèvement supplémentaire dans le secteur du lait et des produits laitiers dans les Açores.
