At this point, Canada has not yet ratified the ICSANT or the CPPNM amendments, as it does not have the legislation in place to criminalize the offences outlined in the ICSANT or some of the offences outlined in the CPPNM amendment.

In addition, the CPPNM Amendment will amend Article 7 of the CPPNM to require States Parties to criminalize certain offences, including acts directed against nuclear facilities or the operation of such facilities where the intention is to cause death, serious injury or substantial damage to property or the environment (currently, Article 7 of the CPPNM only criminalizes such activities in relation to nuclear material).

While the CPPNM Amendment would not amend Article 8 of the CPPNM, its proposed amendment of Article 7 to add new offences to the convention means that Canada would be required, upon ratifying the amendment, to ensure that extraterritorial jurisdiction may be exercised over these new offences.
