Nevertheless, I have been forced to abstain by the fact that a majority of Members of this Parliament still insist on a post-Nice model for debate which, in terms of both method and content, goes further, not only than the conclusions of the Heads of State and Government in Nice, but also than the very Treaties currently in force, especially with regard to its harsh criticism of the intergovernmental method and its ambition to establish a broader, not to say quite unrealistic agenda for this debate.

5.2. The ESC considers that the current phase of developing closer relations with MERCOSUR and Chile and the future association agreements with MERCOSUR and Chile are a prime opportunity to put into practice the provisions of the European social agenda adopted by the Nice European Council (7 to 9 December 2000) which calls for strengthening of the social dimension of the EU's external relations.
5.2. Selon le Comité économique et social, l'actuelle phase de resserrement des liens avec le Mercosur et le Chili ainsi que les futurs accords d'association avec ces deux partenaires offrent l'un et l'autre une possibilité sans précédent de mettre en oeuvre les dispositions contenues dans l'Agenda social européen adopté par le Conseil européen de Nice des 7 et 9 décembre 2000, qui recommandait de renforcer la dimension sociale des relations extérieures de l'UE.

However, the resolution also contains a long section about the current Intergovernmental Conference and, in this connection, we should like to repeat that our vote in favour of the overall resolution does not alter our basic view that extending the agenda and turning the Treaty into a constitution, with the Charter of Fundamental Rights incorporated into it with binding legal effect, will not enhance the possibility of achieving a satisfactory result in Nice in December, something which is absolutely crucial if the enlargement is to be able to go ahead once the countries concerned are ready.
La résolution renferme cependant un vaste chapitre relatif à la conférence intergouvernementale qui est actuellement en cours et nous tenons à répéter, à ce propos, que le fait que nous ayons décidé d'émettre un vote positif sur l'ensemble de la résolution ne modifie en rien notre position de base selon laquelle un élargissement de l'ordre du jour, une "constitutionnalisation" du traité, y compris l'inclusion de la Charte des droits fondamentaux dans le traité avec effet légal, ne facilitera pas l'obtention d'un résultat satisfaisant à Nice en décembre prochain, ce qui est pourtant essentiel si nous voulons une concrétisation de l'élargissement lorsque les pays seront prêts.
