Without prejudice to the application of Directive 75/440/EEC, and in particular Article 4 (3) thereof, when, for its supply of drinking water, a Member State is obliged to resort to surface water which does not reach the concentrations required of category A3 water within the meaning of Article 2 of the aformentioned Directive and when it cannot devise suitable treatment to obtain drinking water of the quality laid down by this Directive, it may, for a limited period of time and up to a maximum permissible value which it shall determine, authorize the maximum admissible concentration shown in Annex I to be exceeded provided that this does not constitute an unacceptable risk to public health.

Sans préjudice de l'application de la directive 75/440/CEE, et, en particulier, de son article 4 paragraphe 3, lorsqu'un État membre est contraint, pour son approvisionnement en eau potable, d'avoir recours à une eau superficielle qui n'atteint pas les concentrations impératives de la catégorie d'eau A 3 au sens de l'article 2 de ladite directive, et qu'il ne peut envisager un traitement approprié pour obtenir une eau alimentaire de la qualité définie par la présente directive, cet État membre peut autoriser, pendant une période de temps limitée et jusqu'à concurrence d'une valeur maximale admissible qu'il fixe, un dépassement des concentrations maximales admissibles figurant à l'annexe I, dans la mesure où ce dépassement ne présente aucun risque inacceptable pour la santé publique.
