The independence of the Conciliation Body is already a clear requirement laid down in Commission Decision No 94/442/EC which, as amended by Decision 2000/649/EC of 12 October 2000, states that the five members of the Conciliation Body must be "selected from among eminent persons offering every guarantee of independence and highly qualified in EAGGF Guarantee Section matters or in the practice of financial audit".

Following the abolition of the European Agricultural Guidance and Guarantee Fund (EAGGF) by Regulation (EC) No 1290/2005, and its replacement by the EAGF as regards the financing of these measures, the terms under which the financing of such measures by the EAGF fits into the system of declarations of expenditure and monthly payments should be made clear.
