B. whereas, in her statement of 19 January 2014, Vice-President / High Representative Catherine Ashton congratulated the Egyptian people and authorities for organising the vote in a largely orderly manner and said that alleged irregularities did not appear to have fundamentally affected the outcome; whereas, according to the Egyptian Ministry of the Interior, 10 people died, many were injured and 444 were arrested in events related to the referendum; whereas various domestic and international actors voiced concerns about procedural irregularities during the vote, the crackdown on those who had been campaigning against the draft constitution, and the one-sided public debate ahead of the referendum;

Notes that, despite the considerable efforts made by the Egyptian, Libyan and Tunisian authorities and the strong political will on all sides, practitioners engaged in the recovery of misappropriated assets have experienced very limited success, owing mainly to the diversity and complexity of the relevant provisions and procedures in the various national legal systems, legal rigidity, the lack of expertise on the part of the Arab Spring countries concerned regarding legal, financial and administrative procedures in European and other jurisdictions and the lack of resources available to them;

Yet we cannot ignore the obverse side, the criminalization of freedom of expression, as in the case of Egyptian blogger Maikel Nabil, or the targeting and murder of journalist Marie Colvin in Syria, or the establishment of an Internet firewall, as in Iran, to quarantine Internet freedom, or that the same Internet that transports the best of free speech also transports the worst of assaultive speech, including even state-sanctioned incitement to genocide, thereby warranting remedy and sanction.

The way we bring about change that is long term, that is sustainable, is through naming the problem, shining the light on it, speaking out, building coalitions and getting support and then supporting the very community to build strong civil society structures so that community in itself, the Egyptian community, with Muslims and Coptic Christians side by side, can build the kind of Egypt where they can all co-exist and cohabit.

The Council urges that the border crossings such as Rafah and Karni be opened and remain open to allow at least the passage of humanitarian aid and basic products to Gaza and the safe return of Palestinians currently on the Egyptian side of the border.
