During the revision of the Directive in 1997, an Article 3 bis was introduced allowing Member States to take measures, in accordance with Community law, to ensure that television broadcasting bodies within their jurisdiction do not broadcast events judged to be of major importance to society on an exclusive basis which denies a significant part of the public the possibility of following these events, live or pre-recorded, free of charge.

More specifically, it replaces the title of the measure; replaces, throughout the text, the term ‘television broadcasting’ by the term ‘linear television’ services; amends the definition of a ‘broadcaster’ exercising an exclusive right concerning an event of major importance (without by this terminological change covering other broadcasters than those covered in the originally notified measures); and restates the latter’s right to broadcast such events on a linear service that does not qualify as free television subject to their exploitation having been offered to providers of such services.

In order to safeguard the fundamental freedom to receive information and to ensure that the interests of viewers in the Union are fully and properly protected, those exercising exclusive television broadcasting rights to an event of high interest to the public should grant other broadcasters the right to use short extracts for the purposes of general news programmes on fair, reasonable and non-discriminatory terms taking due account of exclusive rights.
Afin de sauvegarder la liberté fondamentale de recevoir des informations et d’assurer de façon complète et adéquate la protection des intérêts des téléspectateurs dans l’Union, les titulaires de droits d’exclusivité en matière de radiodiffusion télévisuelle afférents à une manifestation présentant un grand intérêt pour le public devraient octroyer aux autres organismes de radiodiffusion télévisuelle le droit d’utiliser de courts extraits dans leurs programmes d’information générale dans des conditions équitables, raisonnables et non discriminatoires, prenant dûment en compte les droits exclusifs.
