First Nations, in implementing the power of expropriation, would have to respect the principles of natural justice, the general principles common to expropriation in Canada, and due process, such as: service of notice; registration of notice in the Indian Land Registry maintained by the Department of Indian Affairs and Northern Development; the right to object; the establishment of an independent forum to hear objections before an approval for expropriation is granted; and procedures for taking possession of the interest and providing compensation in a timely manner.
