The European Commission has decided to refer Belgium to the EU Court of Justice for failing to bring its legislation into line with EU rules on Customs opening hours and administrative fees.

Contrary to its past assertions, Belgium has now explained that airport taxes should be considered fees and not taxes; the fees are levied on users according to their levels of consumption, while the concept of tax implies equality of all the users faced with it.

(126) In fact, in response to Interested Party C, who asserts that BSCA is not paying for the provision of the infrastructure, Belgium replies that this assertion is incorrect, as "the 35 % ceiling for aeronautical fees is allocated to Sowaer under the terms of the sub-concession agreement of 15 April 2002" and that "part of the fee payable by users of the infrastructure, that is both airlines and passengers, are allocated to Sowaer for participation in the cost of financing the infrastructure.

(57) Still in response to Interested Party C, which believes that BSCA is benefiting from an exemption of one half of the fees payable by BSCA to Sowaer, Belgium explains that: "The concession contracts that bind Sowaer to the operating companies of airports located in the Walloon Region provide that these companies must pay a fee for the provision of the airport infrastructure as well as for its development.

The Court's recognition that university studies constitute vocational training is very important. In February 1985 the Court had already ruled that making the payment of fees in Belgium by students from other Member States a condition of access to vocational training courses constituted an unlawful discrimination. The next step was to determine whether or not university studies constituted vocational training and to deduce from that whether it was also contrary to the Treaty to require fees of university students.
