(52a) Transitional provisions should be added. First, in Article 181(1), as regards the making available again of decommitted appropriations corresponding to commitments made during the 2000-2006 Structural Funds programming period, the case of force majeure should continue to be applied as provided in the Financial Regulation of 25 June 2002 until the closure of the assistance. This is in order to avoid disruption of the current system since force majeure is treated differently in the new Regulation governing the Structural Funds. Second, in Article 181(2), to deal with the implementation of the provisions on the central database for exclusion from participation in procurement and grant procedures. Finally, in Article 181(3) to deal with the outstanding Community commitments to be financially settled in order to close the assistance provided for in the Regulations governing the Structural Funds and the Cohesion Fund for the 2000-2006 programming period.

Expenditure under the current programming period incurred after the final date of eligibility for expenditure of that programming period and relating to operations covered by points 2 and 3 of Rule No 11 of the Annex to Commission Regulation (EC) No 1685/2000 , with the exception of ex post evaluations, audits and preparation of final reports, shall not be eligible under the EAFRD in the new programming period.

Les dépenses au titre de la période de programmation actuelle effectuées après la date limite d’admissibilité des dépenses pour cette période de programmation et relatives aux mesures visées par la règle no 11, points 2 et 3, de l’annexe du règlement (CE) no 1685/2000 de la Commission , à l’exception des évaluations ex post, audits et préparations de rapports finals, ne sont pas imputables au Feader dans le cadre de la nouvelle période de programmation.

2. Expenditure under the current programming period incurred by the final date of eligibility for expenditure of that programming period and relating to operations covered by the first indent of point 2.1 and by point 3 of Rule No 11 of the Annex to Regulation (EC) No 1685/2000, including ex ante evaluations referred to in Article 85 of Regulation (EC) No 1698/2005, for the preparation of rural development programmes under the new programming period, shall be, subject to the conditions laid down in points 2.2 to 2.7 and 3 of that Rule, eligible under the technical assistance component in the current operational programmes or rural development programming documents.

With regard to compliance with Community standards in accordance with Article 33l(2a) and (2b) of Regulation (EC) No 1257/1999, expenditure relating to payments outstanding in respect of commitments to beneficiaries undertaken by the final date of eligibility for expenditure of the current programming period shall be eligible under the EAFRD in the new programming period, provided that the rural development programme for the new programming period makes a provision for such expenditure.
En matière de respect des normes communautaires conformément à l’article 33 quaterdecies, paragraphes 2 bis et 2 ter, du règlement (CE) no 1257/1999, les dépenses relatives aux paiements restant à effectuer au titre d’engagements pris vis-à-vis des bénéficiaires jusqu’à la date limite d’admissibilité des dépenses pour la période de programmation actuelle sont éligibles au titre du Feader dans le cadre de la nouvelle période de programmation dès lors qu’elles ont été prévues dans le programme de développement rural relevant de la nouvelle période de programmation.

The Commission must not restrict itself to mere descriptions as is the case with many reports. It must finally meet the demand made by the European Parliament for the submission of a report evaluating the methods and results of actions implemented within this framework during the previous programming period.
