The inability of Member States to seize control of a failing credit institution and resolve it in a way that effectively prevents broader systemic damage can undermine Member States' mutual trust and the credibility of the internal market in the field of financial services. The stability of financial markets is, therefore, an essential condition for the establishment and functioning of the internal market.
L'incapacité des États membres à prendre le contrôle d'un établissement de crédit défaillant, et à organiser sa faillite pour éviter des dommages systémiques importants, peut saper la confiance mutuelle entre États membres et la crédibilité du marché intérieur dans le domaine des services financiers. Accordingly, ESMA may adopt measures that are legally binding on the EU Member States’ financial markets where there is a threat to the orderly functioning and integrity of financial markets or to the stability of the whole or part of the financial system in the EU.

(24) In order to ensure the orderly functioning and integrity of financial markets, investor protection and financial stability it is necessary to provide a mechanism for monitoring of the design of investment products and for powers to prohibit or restrict the marketing, distribution and sale of any investment product or financial instrument giving rise to serious concerns regarding investor protection, the orderly functioning and integrity of financial markets, or the stability of the whole or part of the financial system, together with appropriate coordination and contingency powers for ESMA. The exercise of such powers by competent authorities and, in exceptional cases, by ESMA should be subject to the need to fulfil a number of specific conditions.

- Mr President, the key strategy the EU Commission has for Europe up to 2020 is reliance on neoliberal capitalism and a market system – in other words, the exact same factors that have plunged the world into the current economic chaos and illustrated in the Commission’s and EU governments’ response to the financial crisis in Greece: a shameful capitulation to the speculation and profiteering by the sharks in the financial markets; demanding that the Greek working class, pensioners and poor should have their services and living standards savaged to feed the insatiable greed of these financial markets, which are not some kind of an all-powerful god, as media commentators would have us believe, but investment banks, hedge-fund operators, bond holders and the like – parasites seeking super profits by deliberately speculating to create financial instability and then exploiting that to bleed working people. Is this the Europe we want for 2020?
- (EN) Monsieur le Président, la stratégie essentielle de la Commission européenne pour l’Europe d’ici à 2020 repose sur la confiance dans le capitalisme néolibéral et dans un système de marché - en d’autres mots, les mêmes facteurs exactement que ceux qui ont plongé le monde dans le chaos économique actuel et qu’illustre la réponse de la Commission et des gouvernements de l’Union europenne à la crise financière en Grèce: une honteuse capitulation face à la spéculation et aux requins profiteurs des marchés financiers; demander à la classe ouvrière, aux retraités et aux pauvres de Grèce de rogner sur leurs services et leurs conditions de vie pour alimenter la soif insatiable de ces marchés financiers, qui ne sont pas une sorte de veau d’or tout puissant comme les commentateurs des médias voudraient nous le faire croire, mais des banques d’investissement, des opérateurs de fonds spéculatifs, des détenteurs d’obligations et des parasites de ce genre à la recherche de super profits, qui spéculent sciemment pour créer de l’instabilité financière et ensuite pour l’exploiter afin de saigner les travailleurs. Est-ce là l’Europe que nous voulons pour 2020?

The European Parliament, which has long called for an increased convergence of national supervisory practices and improvement of existing crisis management arrangements in the EU, therefore welcomes both ECOFIN Council Conclusions, and shares the view that a consistency between the evolution of going concern supervisory arrangements, both at national and cross-border levels, and that of crisis management/ financial stability arrangements is needed. Having regard to the two ECOFIN Council Conclusions, and to the still-unfolding financial crisis whose speed and pace has taken by surprise many market participants and supervisors, having regard to the threats the crisis still poses to the EU financial markets and to its spill-over into the EU economy, what does the Presidency consider as appropriate steps to be undertaken in this area in order to better respond to the challenges of globally integrated markets and to preserve the soundness and stability of the EU financial markets?

The European Parliament, which has voiced several calls for increased convergence of national supervisory practices and improvement of existing crisis management arrangements in the EU, welcomes the main actions proposed in the Commission Communication. Having regard to the two ECOFIN Council Conclusions, having regard to the still-unfolding financial crisis whose speed and pace has taken by surprise many market participants and supervisors, and having regard to the threats the crisis still poses to the EU financial markets and to its spill-over into the EU economy, what is the Commission intending to undertake in this area in order to better respond to the challenges of globally integrated markets and to preserve the soundness and stability of the EU financial markets?

It stresses the importance of adoption by the EU of high quality international accounting standards, as well as their recognition by other jurisdictions; emphasises that clearing and settlement, improving the legal framework for retail payments, reducing obstacles to electronic financial services, the UCITS directive and the integration of upstream market functions in general are areas of particular importance for financial market integration; notes that general consumer protection, private law, competition policy and taxation are key areas for the competent Community and national bodies to consider in relation to financial services aspects; invites the Commission to take full account of the FSC report and where appropriate specify timelines for the initiatives proposed in the report in its further work to develop the EU financial services market after the Financial Services Action Plan; and considers that it is important to continue to improve corporate governance, audit and accounting standards, and the reform of European company law.
Il insiste sur la nécessité d'adopter, au niveau de l'UE, des normes comptables internationales de qualité et reconnues par d'autres instances; insiste sur le fait que la compensation et le règlement, l'amélioration du cadre juridique pour les paiements de détail, la réduction des entraves aux services financiers électroniques, la directive OPCVM et l'intégration des fonctions de marché en amont en général, constituent des domaines particulièrement importants pour l'intégration des marchés financiers; constate que la protection des consommateurs en général, le droit privé, la politique en matière de concurrence et la fiscalité sont des domaines clés qui doivent être examinés par les instances communautaires et nationales compétentes, pour ce qui est des aspects liés aux services financiers; invite la Commission à tenir pleinement compte du rapport du CSF et, le cas échéant, à fixer un calendrier pour les initiatives proposées dans le rapport, dans le cadre des efforts qu'elle continuera à déployer pour mettre en place un marché des services financiers à l'échelle de l'UE, à la suite du PASF; estime qu'il est important de continuer à améliorer le gouvernement d'entreprise, l'audit et les normes comptables et de poursuivre la réforme de la législation sur la société européenne.
