TRADUCTIONS EN CONTEXTE

As indicated in recital 9 of Regulation (EU, Euratom) 2015/2422, the increase by seven of the number of Judges of the General Court on 1 September 2016 should be accompanied by the transfer to the General Court of jurisdiction at first instance in disputes between the Union and its servants under Article 270 of the Treaty on the Functioning of the European Union (TFEU).
Ainsi qu'il est indiqué au considérant 9 du règlement (UE, Euratom) 2015/2422, l'augmentation de sept postes du nombre de juges du Tribunal au 1er septembre 2016 devrait s'accompagner du transfert au Tribunal de la compétence pour statuer, en première instance, sur les litiges entre l'Union et ses agents en vertu de l'article 270 du traité sur le fonctionnement de l'Union européenne.

IMCO further refers to another amendment (AM 2) which adds to the text proposed by the Commission in the first recital "Article 169(1) and Article 169(2)(a) TFEU provide that the Union is to contribute to the attainment of a high level of consumer protection through the measures adopted pursuant to Article 114 thereof" the expression "inter alia", so that the last half sentence now reads "inter alia through the measures adopted pursuant to Article 114 thereof".

Since that article is not a legal basis it is sufficient for a reference to be made to Article 169 in the first recital in the preamble as Amendment 2 adopted by IMCO proposes: "Article 169(1) and Article 169(2)(a) TFEU provide that the Union is to contribute to the attainment of a high level of consumer protection inter alia through the measures adopted pursuant to Article 114 thereof".

Its delegation managed to secure the incorporation of the phrase ‘protection against deterioration’ in the title of the directive and among its objectives and the inclusion of corresponding references in the first recital and in Article 5(2), which deals with upward trends and trend reversal. The idea of precautionary action and, by extension, that of a ban on deterioration was incorporated into Article 6(1)(b), so that in the event of indirect discharges as well deterioration, and, in connection with that, augmentation, can be prevented.

According to the first recital of the contested decision, the amount owing to the Parliament is EUR 176 576 and, as the applicant had already repaid EUR 58 155.82 in monthly instalments of EUR 3 000 (see paragraph 47 above), the amount repayable is EUR 118 360.18.
