326 (1) A claim to be a Convention refugee made by a person described in subparagraph 19(1)(c.1)(i) of the former Act in respect of whom the Minister was of the opinion under subparagraph 46.01(1)(e)(i) of the former Act that the person constitutes a danger to the public in Canada is deemed, if no determination was made by a senior immigration officer under section 45 of the former Act, to be a claim for refugee protection made by a person described in paragraph 101(2)(b) of the Immigration and Refugee Protection Act who is inadmissible and in respect of whom the Minister is of the opinion that the person is a danger to the public.

(4) Where the Board, having regard to the extent and duration of the sales of the medicine at an excessive price, is of the opinion that the patentee or former patentee has engaged in a policy of selling the medicine at an excessive price, the Board may, by order, in lieu of any order it may make under subsection (2) or (3), as the case may be, direct the patentee or former patentee to do any one or more of the things referred to in that subsection as will, in the Board’s opinion, offset not more than twice the amount of the excess revenues estimated by it to have been derived by the patentee or former patentee from the sale of the medicine at an excessive price.

(3) Subject to subsection (4), where the Board finds that a former patentee of an invention pertaining to a medicine had, while a patentee, sold the medicine in any market in Canada at a price that, in the Board’s opinion, was excessive, the Board may, by order, direct the former patentee to do any one or more of the following things as will, in the Board’s opinion, offset the amount of the excess revenues estimated by it to have been derived by the former patentee from the sale of the medicine at an excessive price:

(c) Whereas EMPL raised already concerns in former opinions (EGF/2009/007 SE/Volvo and EGF 2009/009 AT/Steiermark) with regard to the impact of the financial and economic crisis on the European automotive sector which is not only suffering due to the financial crisis and globalisation adjustments but also because of a lack of willingness of the management to adapt to current challenges stemming from consumer needs as well as environmental impact. And, calls upon all stakeholders to take care that the take over by the Volkswagen Group will have a positive effect on the employment situation of the company Karmann.

Welcomes the fact that the parties in government and the opposition in the former Yugoslav Republic of Macedonia, with the widespread support of civil society and public opinion, are united in their desire to fulfil the Copenhagen criteria for EU membership and for the earliest possible accession to the EU; in which connection emphasises that it is not primarily a matter of complying with externally imposed requirements but rather of improving the candidate country's own future;
1. se félicite que les partis au gouvernement et l'opposition de l'ancienne République yougoslave de Macédoine, largement soutenus par la société civile et l'opinion publique, soient unis dans la volonté de satisfaire aux critères d'adhésion de Copenhague et d'adhérer, le plus tôt possible, à l'Union; souligne à cet égard qu'il ne s'agit pas en premier lieu de satisfaire à des exigences imposées de l'extérieur, mais plutôt d'améliorer l'avenir propre du pays candidat;

15. Observes that, in a democracy, interaction occurs between the government and the opposition in which there is always room for conflicting opinions, attention is paid to alternative solutions and there is scope for establishing majorities in favour of a change of policy, and that it is important to ensure that sections of the population do not become afraid that this tolerance will decline if one party has a parliamentary majority, which has been the case in the former Yugoslav Republic of Macedonia since the last parliamentary elections;

The former opinion appears, for the time being, to have the upper hand; while not deploring this outcome, I do consider the resistance to unacceptable rule an inherent right of all people, and Solidarity an inspiring example.

B. whereas the Former Yugoslav Republic of Macedonia has been successfully involved in negotiations relating inter alia to relations with the European Union, such as the Stabilisation and Association Agreement (SAA), the Central European Free Trade Association (CEFTA), the efforts of the European Union regarding peaceful resolution of internal differences of opinion in 2001 and the preparations for adopting the EU acquis in the period leading up to 2011,
B. considérant que l'ancienne République yougoslave de Macédoine a été associée avec succès à des accords qui concernent notamment la relation avec l'Union européenne, tels que l'Accord de stabilisation et d'association (ASA), l'Accord de libre-échange d'Europe centrale (Central European Free Trade Association, CEFTA) et considérant les efforts de l'Union européenne en vue du règlement pacifique des divergences d'opinion internes en 2001, ainsi que les préparatifs en vue de l'adoption de l'acquis communautaire d'ici 2011,
