As regards a possible WTO Panel, the rapporteur believes a ban can be justified under article XX (a) of the GATT (protection of public moral), since moral concerns of the European public have been widely demonstrated and documented and there is no viable less trade-restrictive measure available which would address these concerns in an adequate way.

It is also important in the WTO negotiations that, where the trade in services or GATTS is concerned, the right of every WTO member to regulate public services should be guaranteed and that developing countries must not be compelled to hand government control of basic services such as health care over to the market.

Whereas, when applying the abovementioned rules to the current market situation, having regard in particular to wine prices in the Community and on the world market, the level of refunds should be reduced; whereas, in order to avoid disturbances on the Community market, having regard to production for the current wine year, the quantities of Community products eligible for export refunds should be maximized within the limits on volumes based on the GATT Agreements; whereas, to that end, the amount of the refunds should be reduced on account of the obligations arising from the GATT Agreements concerning maximum authorized expenditure; whereas, therefore, the refunds should be fixed in accordance with the Annex to this Regulation; whereas Commission Regulation (EC) No 2805/95 of 5 December 1995 fixing the export refunds in the wine sector (3) should be amended accordingly and provision made to implement it immediately;
considérant que, lors de l'application des règles susmentionnées à la situation actuelle du marché, en particulier au regard des prix des vins dans la Communauté et sur le marché mondial, le niveau des restitutions devrait être baissé; que, en effet, dans le but d'éviter des perturbations sur le marché de la Communauté compte tenu de la production de la campagne en cours, il y a lieu de maximaliser les quantités de produits communautaires pouvant être exportées avec restitutions tout en respectant les limites en matière de volumes découlant des accords GATT; que, afin d'arriver à ce résultat, il est nécessaire de diminuer le montant des restitutions en raison des obligations découlant des accords GATT en matière de dépenses maximales autorisées; que, en conséquence, les restitutions doivent être fixées conformément à l'annexe du présent règlement et qu'il y a donc lieu de modifier le règlement (CE) n° 2805/95 de la Commission, du 5 décembre 1995, fixant les restitutions à l'exportation dans le secteur viti-vinicole (3), et de prévoir son application immédiate;
