Definition: A disorder characterized by impairment of memory, learning difficulties, and reduced ability to concentrate on a task for more than brief periods. There is often a marked feeling of mental fatigue when mental tasks are attempted, and new learning is found to be subjectively difficult even when objectively successful. None of these symptoms is so severe that a diagnosis of either dementia (F00-F03) or delirium (F05.-) can be made. This diagnosis should be made only in association with a specified physical disorder, and should not be made in the presence of any of the mental or behavioural disorders classified to F10-F99. The disorder may precede, accompany, or follow a wide variety of infections and physical disorders, both cerebral and systemic, but direct evidence of cerebral involvement is not necessarily present. It can be differentiated from postencephalitic syndrome (F07.1) and postconcussional syndrome (F07.2) by its different etiology, more restricted range of generally milder symptoms, and usually shorter duration.

G. v EESC, in which the General Court found against the EESC in connection with the reporting of irregularities concerning the former Secretary-General by the head of the EESC Legal Service; calls on the EESC and its new Secretary-General to take the steps required to prevent further serious breaches of the Charter of Fundamental Rights of the European Union, to inform the EESC Bureau, the members, and the entire staff about the content of the two judgments, and to draw their attention to the fact that officials and other staff covered by the Staff Regulations have an obligation to report irregularities and that the EESC Bureau is an appropriate body to receive such reports; also asks to be informed about the total legal expenses incurred in the last five years in staff cases ultimately dealt with in the courts or by the Ombudsman;

Is deeply concerned that for the second consecutive year the Court found no reasonable assurance on the legality and regularity of the Institute’s grant transactions; notes that about 87 % of grant expenditure claimed by the beneficiaries is covered by certificates issued by independent audit firms, which are contracted by the beneficiaries themselves and their partners; regrets that although the Institute continued to make efforts to implement effective ex ante verifications and give better guidance to the independent audit firms, the Court found their quality as insufficient and noted that there is room for further improvement in their general work; calls on the Institute to address this issue and to inform the discharge authority about the steps taken by 1 September 2015;

In that connection the General Court: (1) found, incorrectly, that the fact that the measure which has an adverse effect on the individual members of the applicant association also affects other does not preclude those members from being individually concerned; (2) found, incorrectly, that only the relevant members had claimed to be in competition with the recipients of the aid; and (3) thereby failed, incorrectly, to accord weight to the specific calculations which the appellants had submitted showing that the aid would inevitably have an adverse effect on their market position; and (4) in addition to the error referred to in (1), incorrectly failed to see that the measure having an adverse effect is not the same for all operators; (5) incorrectly assumed that the appellants must provide proof of loss of income which has already occurred in order to have standing to bring proceedings; (6) incorrectly dismissed claims of adverse effect on the basis of other, undocumented causes of the adverse effect; and (7) ruled out the possibility of easing the requirements for having standing on the ground that the Commission’s decision to allow the aid under Article 107(3)(c) had not been dealt with administratively on its merits.

En outre, le Tribunal: 5o) a jugé à tort que les requérantes devaient établir une baisse constatée de leur chiffre d’affaires pour avoir qualité à agir; 6o) a rejeté des effets négatifs établis au motif d’autres causes d’effets négatifs non précisées; 7o) n’a pas tenu compte du fait que les conditions pour introduire un recours doivent être assouplies, car la décision de la Commission d’autoriser la mesure d’aide, en application de l’article 107, paragraphe 3, sous c), TFUE, n’a pas fait l’objet d’un véritable examen administratif préalable.

19. Calls on the Directorates General which still have high figures, in particular DG INLO, to further reduce the number/proportion of such procedures; urges the administration to continue the strict scrutiny of these procedures, in particular with respect to possible conflicts of interest, and to apply intensified and dissuasive sanctions for any irregularity found; calls on the Secretary-General to report on a six-monthly basis to the Committee on Budgetary Control on progress made;

Pursuant to Article 2(7)(a) of the basic Regulation, normal value for Since Hardware was established on the basis of verified information received from the sole cooperating Union producer, i.e. on the basis of prices paid or payable on the Union market for comparable product types, where these were found to be made in the ordinary course of trade, or on constructed values, where no domestic sales in the ordinary course of trade for comparable product types were found, i.e. on the basis of the cost of manufacturing of ironing boards manufactured by the Union producer plus a reasonable amount for selling, general and administrative (SGA) expenses and for profit.

Where the Court has already ruled on one or more questions of law identical to those raised by the pleas in law of the appeal or cross-appeal and considers the appeal or cross-appeal to be manifestly well founded, it may, acting on a proposal from the Judge-Rapporteur and after hearing the parties and the Advocate General, decide by reasoned order in which reference is made to the relevant case-law to declare the appeal or cross-appeal manifestly well founded.
