IN-CONTEXT TRANSLATIONS

In view of considerations in connection with both the purely technical nature of the agencies and, more generally, the principles on which the Community legal order is based, the White Paper on European Governance placed further restrictions on the decision-making agencies' scope for action, authorising them to intervene only in areas where a single public interest predominates and in areas where the agencies are not called upon to arbitrate on conflicting public interests, exercise any powers of political appraisal or conduct any complex economic assessments.
Eu égard à des considérations liées tant à la nature purement technique des agences, que, plus généralement, aux principes de l'ordre juridique communautaire, le Livre blanc sur la gouvernance européenne a énuméré des limites ultérieures pour ce qui concerne le champ d'intervention des agences décisionnelles. En particulier, on peut avoir recours à de telles agences uniquement dans des domaines où un seul intérêt public prédomine, ainsi que dans des domaines où ces agences ne sont pas appelées à arbitrer des conflits entre intérêts publics, à exercer un pouvoir d'appréciation politique ou à procéder à des évaluations économiques complexes.

The Minister of Justice, the SCM and the High Court of Cassation and Justice should finalise an action plan to ensure that the new deadline for the implementation of the remaining provisions of the Code of Civil Procedures can be respected. In order to improve further the transparency and predictability of the legislative process, and strengthen internal safeguards in the interest of irreversibility, the Government and Parliament should ensure full transparency and take proper account of consultations with the relevant authorities and stakeholders in decision-making and legislative activity on the Criminal Code and Code for Criminal Procedures, on corruption laws, on integrity laws (incompatibilities, conflicts of interest, unjustified wealth), on the laws of justice (pertaining to the organisation of the justice system) and on the Civil Code and Code for Civil Procedures, taking inspiration from the transparency in decision-making put in place by the Government in 2016. The Government should put in place an appropriate Action Plan to address the issue of implementation of court decisions and application of jurisprudence of the courts by public administration, including a mechanism to provide accurate statistics to enable future monitoring.
Le ministre de la justice, le CSM et la Haute Cour de cassation et de justice doivent mettre la dernière main à un plan d'action pour que le nouveau délai de mise en œuvre des dispositions restantes du code de procédure civile puisse être respecté; afin d'améliorer davantage la transparence et la prévisibilité du processus législatif, et de renforcer les garde-fous internes dans l'intérêt de l'irréversibilité des résultats, le gouvernement et le Parlement doivent garantir la transparence totale et tenir dûment compte des consultations avec les autorités concernées et les parties prenantes dans le cadre du processus décisionnel et des activités législatives relatives au code pénal et au code de procédure pénale, aux lois sur la corruption, aux lois sur l'intégrité (incompatibilités, conflits d'intérêts, enrichissement injustifié), aux lois de la justice (concernant l'organisation du système judiciaire), ainsi qu'au code civil et au code de procédure civile, en s'inspirant de la transparence du processus décisionnel mis en place par le gouvernement en 2016; le gouvernement doit mettre en place un plan d'action adéquat visant à traiter le problème posé par l'exécution des décisions de justice et l'application de la jurisprudence des cours et tribunaux par l'administration publique, comprenant notamment un mécanisme fournissant des statistiques exactes pour permettre le suivi de ces questions à l'avenir.

Welcomes the decision of the Bulgarian government to halt works on the South Stream project; is, however, deeply concerned at the recent decision of the Austrian government to further invest in the South Stream project, as well as the decision of the Hungarian government to sign an agreement on nuclear energy with Russia; is convinced that the recent visit of President Putin to Vienna and the signature of a South Stream-related contract between OMV and Gazprom represent a severe setback regarding the aim of creating a consistent European approach to the crisis in Ukraine, and, notably, a European energy security policy;
22. se félicite de la décision du gouvernement bulgare d'interrompre les travaux sur le projet South Stream; s'inquiète toutefois vivement de la décision du gouvernement autrichien de continuer d'investir dans ce projet et de celle du gouvernement hongrois de signer un accord avec la Russie dans le domaine de l'énergie nucléaire; est convaincu que la visite récente du président Poutine à Vienne et la signature d'un contrat autour de South Stream entre ÖMV et Gazprom infligent un sérieux revers à l'objectif de mettre en place une approche européenne cohérente face à la crise en Ukraine ainsi qu'une politique européenne commune en matière de sécurité énergétique;

Expresses its anxiety at the delays in setting up paying agencies and the integrated administration and control system, which have to be properly in operation to enable direct payments to be made to farmers; notes, given the complexity of the procedures, that the Commission needs to provide greater technical assistance, to be combined with the efforts of the Polish authorities, which, in accordance with the government decision of 6 November 2003, will significantly raise the number and skill levels of personnel working in this sector; insists that information policy and the involvement of civil society in rural development measures need to be substantially improved in order to stabilise the rural economy and to avoid further massive unemployment in rural regions; urges the Polish Government to fully implement the agro-environmental measures and to support the Leader-type local action groups in their integrative rural development efforts;

Takes the view that conditions should be laid down to govern membership of the UN Commission on Human Rights, such as the signing, ratification and implementation of international human rights conventions and the admission to the country concerned of a special UN rapporteur; takes the view, further, that there should be a shift in the rule governing decision-making in the UN Commission from unanimity to that of a two-thirds majority;
