19. Recalls that as a consequence of the 2008 decision of the Nuclear Suppliers Group (NSG) on the exemption rule for India, China offered similar nuclear technology exports to Pakistan; deeply regrets the position taken by several European leaders in 2010 in favour of granting India full membership in the Nuclear Suppliers Group (NSG) namely French President Sarkozy and German Chancellor Merkel; calls on EU Member States to abandon the idea of a NSG membership for India ahead of the June 2011 NSG meeting in the Netherlands because it would strengthen and formalize double standards and severely weaken international efforts in the field of nuclear non-proliferation and disarmament in accordance with the Action Plan agreed to at the 2010 NPT Review Conference; urges EU Member States to revoke the 2008 exemption decision for India and to only grant India NSG membership rights in case the country signs, ratifies and implements all relevant international nuclear non-proliferation and disarmament norms such as NPT, Comprehensive Nuclear-Test-Ban Treaty (CTBT) and Fissile Material Cut-off Treaty (FMCT);
19. rappelle qu'à la suite de la décision prise en 2008 par le groupe des fournisseurs nucléaires (GFN) d'accorder une dérogation à l'Inde, la Chine a proposé d'exporter des technologies nucléaires similaires vers le Pakistan; déplore vivement la position adoptée en 2010 par plusieurs dirigeants européens, à savoir le Président français Sarkozy et la Chancelière allemande Merkel, en faveur d'une adhésion pleine et entière de l'Inde au groupe des fournisseurs nucléaires; demande aux États membres de l'Union de renoncer à l'idée d'une adhésion de l'Inde au groupe des fournisseurs nucléaires avant la réunion dudit groupe qui doit se tenir en juin 2011 aux Pays-Bas, étant donné que cela renforcerait et officialiserait la pratique consistant à appliquer deux poids et deux mesures, tout en affaiblissant sérieusement les efforts internationaux consentis dans le domaine de la non-prolifération et du désarmement nucléaires conformément au plan d'action convenu lors de la Conférence d'examen 2010 du traité de non-prolifération; invite instamment les États membres de l'Union à annuler la dérogation décidée en 2008 en faveur de l'Inde et à n'accorder à ce pays le droit de siéger au GFN que s'il signe, ratifie et met en œuvre toutes les normes internationales applicables en matière de non-prolifération et de désarmement nucléaires, comme le traité sur l'interdiction complète des essais nucléaires (CTBT) et le traité interdisant la production de matières fissiles (FMCT);

As to the continuation of subsidisation, the applicant alleges that the producers of the product under review in India have benefited and will continue to benefit from a number of subsidies granted by the Government of India.

It is alleged that the producers of the product concerned from India have benefitted from a number of subsidies granted by the Government of India and from regional subsidies.

As regards the comments made on nuclear cooperation, I would like to remind you that, on 6 September 2008, an agreement was concluded by the Nuclear Suppliers Group, in which it was agreed to grant a derogation making it possible to establish trade relations with India in the field of civil nuclear power, under the supervision of, with the agreement of and in respect of the conditions set by the International Atomic Energy Agency. I would also stress that India has pledged to extend its moratorium on nuclear testing and that the civil and military programmes should not be confused.
En ce qui concerne les observations qui ont été faites à propos de la coopération nucléaire, je rappelle qu'il y a eu le 6 septembre dernier un accord conclu par le groupe des fournisseurs nucléaires, par lequel il a été décidé d'accorder une dérogation permettant de nouer avec l'Inde des relations commerciales dans le domaine nucléaire civil, sous le contrôle, avec l'accord et dans le respect des conditions posées par l'Agence internationale de l'énergie atomique, et je rappellerai également que l'Inde s'est engagée à prolonger son moratoire sur les essais nucléaires et, enfin, que les programmes civils et militaires doivent être clairement séparés.

Article 2 of the original Regulation stipulates that where any new exporting producer in India provides sufficient evidence to the Commission that it did not export to the Community the products described in Article 1(1) of that Regulation during the investigation period (1 October 2001 to 30 September 2002) (the first criterion), that it is not related to any of the exporters or producers in India which are subject to the anti-subsidy measures imposed by that Regulation (the second criterion) and that it has actually exported to the Community the products concerned after the investigation period on which the measures are based, or that it has entered into an irrevocable contractual obligation to export a significant quantity of the product concerned to the Community (the third criterion), then Article 1(3) of that Regulation may be amended by granting the new exporting producers the duty rate applicable to the cooperating companies not included in the sample, i.e. 7,6 %.
L’article 2 du règlement initial dispose que, lorsqu’un nouveau producteur-exportateur en Inde fournit à la Commission des éléments de preuve suffisants pour établir qu’il n’a pas exporté vers la Communauté les produits visés à l’article 1er, paragraphe 1, dudit règlement, au cours de la période d’enquête (du 1er octobre 2001 au 30 septembre 2002) («la période d’enquête») (premier critère), qu’il n’est lié ni à un exportateur ni à un producteur en Inde soumis aux mesures compensatoires instituées par ce règlement (deuxième critère) et qu’il n’a exporté le produit concerné vers la Communauté qu’après la période d’enquête sur laquelle les mesures sont fondées ou qu’il a souscrit une obligation contractuelle et irrévocable d’exportation d’une quantité importante du produit concerné vers la Communauté (troisième critère), alors l’article 1er, paragraphe 3, du règlement peut être modifié de manière à accorder au nouveau producteur-exportateur le taux de droit applicable aux sociétés ayant coopéré non incluses dans l’échantillon, soit 7,6 %.

We can convince all rich countries to grant the 49 poorest countries in the world the same conditions granted by the EU through the ‘Everything but Arms’ initiative. We can force a clear distinction to be drawn between developing countries and the poorest countries in the world, since it is unrealistic to put countries such as India, Malaysia, Indonesia and various South American States in the same class as Mozambique, Chad, Burkina Faso and most of the African, Caribbean and Pacific (ACP) States.
