On 22 December 1988, the Commission decided that Greek legislation which allowed the name "feta" only for cheeses made from sheep milk and goat milk did not infringe Article 30 of the EEC Treaty as interpreted by the Court of Justice in the Déserbais case. According to that judgment, an imported foodstuff could be prohibited from bearing the designation used in the Member State of origin where it "is so different, as regards its composition or production, from the products generally known by that name in the Community that it cannot be regarded as falling within the same category" (Case 286/86, [1988] ECR 4921.) In 1990 the Commission received several complaints from traders in this connection, as a result of which it has conducted a long and exhaustive inquiry into the implementation of the Greek legislation regarding the type of milk used, to make sure there was no hidden discrimination against traders in other Member States.
En date du 22.12.1988, la Commission estima que la législation hellénique réservant la dénomination Feta aux seuls fromages fabriqués à partir de lait de brebis et de chèvre, ne constituait pas une infraction à l'article 30 du traité CEE, tel qu'interprété par la CJCE dans sa jurisprudence Déserbais; en vertu de celle-ci, une denrée alimentaire importée pourrait être privée de la dénomination qu'elle porte dans l'Etat membre dont elle provient lorsqu'elle "s'écarte tellement, du point de vue de sa composition ou de sa fabrication, des marchandises généralement connues sous cette dénomination dans la Communauté qu'elle ne saurait être considérée comme relevant de la même catégorie". Suite à la réception, au cours de l'année 1990, de plaintes émanant d'opérateurs économiques, la Commission a procédé à une longue et minutieuse enquête eu égard à la mise en oeuvre effective de la législation hellénique afférente au type de lait utilisé, aux fins de pallier à toute discrimination subreptice dont pourraient pâtir les opérateurs d'autres Etats membres.
