This is shown by the fact that, according to the information transmitted by the Greek authorities (see above, recitals 13 and 16), the guarantee was initially supposed to cover 80 % of the loan, or EUR 18,2 million, but eventually, on the basis of one of the provisions of the guarantee scheme, covered EUR 30 million.

Believes that the various experiments with minimum incomes and with a guaranteed basic income for everyone, accompanied by additional social integration and protection measures, show that these are effective ways of combating poverty and social exclusion and providing a decent life for all; therefore calls on the Commission to prepare an initiative to support further experiments in the Member States, taking into account and promoting best practices, and ensuring various individually guaranteed poverty-preventing adequate minimum and basic income models as a means of fighting to eradicate poverty and guarantee social justice and equal opportunities for every individual whose need can be established on the basis of the relevant regional yardstick, in keeping with the subsidiarity principle, and without calling into question the specific situations in each Member State; takes the view that this Commission initiative should lead to the drawing-up of an action plan, designed to accompany the implementation of a European initiative on minimum income in the Member States, in accordance with different national practices, collective bargaining and Member States' legislation, in order to achieve the following objectives:
34. considère que l'expérience diversifiée de revenus minimaux et de revenus de base pour tous et sans condition, accompagnés de mesures supplémentaires d'insertion et de protection sociale, démontre qu'il s'agit bien d'outils efficaces pour lutter contre la pauvreté et l'exclusion sociale, et pour garantir une vie dans la dignité pour tous; demande donc à la Commission une initiative pour soutenir d'autres expériences dans les États membres qui tiennent compte des meilleures pratiques et les encouragent, et qui permettent de garantir individuellement divers modèles de revenu minimum adéquat et de revenu de base prévenant la pauvreté comme mesure de lutte pour l'éradication de la pauvreté et pour garantir la justice sociale et l'égalité des chances pour tous les citoyens dont il faut déceler la pauvreté à leur échelon régional respectif, dans le respect du principe de subsidiarité et sans remettre en question les spécificités de chaque État membre; estime que cette initiative de la Commission devrait aboutir à l'élaboration d'un plan d'action destiné à accompagner la mise en œuvre d'une initiative européenne sur le revenu minimum dans les États membres, dans le respect des différentes pratiques nationales, conventions collectives et législations des États membres afin d'atteindre les objectifs suivants:

(32) In accordance with the conclusions of the Lisbon European Council, the Council and Commission are to report by the end of 2000 on the review of the EIB and EIF financial instruments which was undertaken in order to redirect funding towards business start-ups, high-tech firms and micro-enterprises, as well as other risk capital or guarantee mechanism initiatives proposed by the EIB and EIF.
(32) Conformément aux conclusions du Conseil européen de Lisbonne, le Conseil et la Commission devraient faire rapport d'ici à la fin de l'année 2000 sur le réexamen des instruments financiers relevant de la BEI et du FEI qui a été entamé afin de réorienter les financements vers un soutien au démarrage des entreprises, aux sociétés à haute technologie et aux micro-entreprises, ainsi qu'aux autres initiatives en matière de capital-risque ou de mécanismes de garantie proposées par la BEI et le FEI.

It has to be said that either we subscribe to the democratic model with which we are familiar, one based on the division of powers, and one which recognises that the courts have supreme authority when it comes to guaranteeing individual rights, and we acknowledge that European judicial cooperation in criminal matters consists precisely of reinforcing coordination between European courts in their capacity of protectors of fundamental rights – and this is the model to which I personally subscribe – or we can choose not to subscribe to this model and, in that case, I fail to understand how one can see this initiative for developing a common judicial area as posing any threat to guarantees on fundamental rights.
Il faut en effet le dire. Ou bien on souscrit au modèle de démocratie que nous connaissons, qui est basé sur la séparation des pouvoirs, qui reconnaît que les instances suprêmes de garantie des droits individuels sont les tribunaux, et on reconnaît que la coopération judiciaire européenne au niveau pénal consiste précisément à renforcer la coordination des tribunaux européens dans leur rôle de protection des droits fondamentaux.
