As far as the question of legal basis is concerned, it would appear that a majority of Member States in the Council take the view that the proposed directive should be limited to cross-border cases on the ground that, under Article 65 of the EC Treaty, measures "eliminating obstacles to the good functioning of civil proceedings, if necessary by promoting the compatibility of the rules on civil procedure applicable in the Member States" have to have "cross-border implications" and to be taken in so far as they are "necessary for the proper functioning of the internal market".
