It guarantees the protection of 15 or so rights that are not protected under the Canadian charter. Under the Quebec charter, every human being whose life is in peril has a right to assistance under section 2; every person has a right to respect for his private life under section 5; every person has a right to non-disclosure of confidential information under section 9; every person has a right to free public education under section 40; and every person has a right to financial assistance in certain conditions under section 45.

It should be noted that the aboriginal rights recognized and affirmed by s.35(1) [of the Constitution Act, 1982] exist within a legal context in which, since the time of the Magna Carta, there has been a common law right to fish in tidal waters that can only be abrogated by the enactment of competent legislation.While the elevation of common law aboriginal rights to constitutional status obviously has an impact on the public's common law rights to fish in tidal waters, it was surely not intended that, by the enactment of s.35(1), those common law rights would be extinguished in cases where an aboriginal right to harvest fish commercially existed.As a common law, not constitutional, right, the right of public access to the fishery must clearly be second in priority to aboriginal rights; however, the recognition of aboriginal rights should not be interpreted as extinguishing the right of public access to the fishery.

The Commissioner said that the following questions should be examined in the further development of the Charter : - whether or not the Charter should be limited to social rights in the strict sense of the term, or whether it should also cover economic and cultural rights or even civil and political rights; - whether it should enshrine such concepts as the right to an adequate level of physical and mental health, the right to education, to family protection, to minimum income, the right to participate in cultural life and the right to housing, - the right of free association and the right of free collective bargaining, a fundamental principle of our common European heritage; - the prohibition of discrimination between EU citizens and the legally resident non-EU citizens in work related issues, as well as the rights of third country nationals not to be arbitrarily excluded from the Union and the right to family union, are also fundamental questions; - the right to non-discrimination on the grounds of race, colour, sex, religion, age and disability must be enshrined in the Constitution of the European Union in a way that is legally actionable by individual citizens.
