The Commission's legislative proposal[12] to revise EU data protection law[13] defends the need for a specific approach to health data based on ensuring the right of individuals to protection, access and use of their personal information, including health data, and enabling the legitimate interests of public health protection, scientific research and development of health services.

In some Member States, these requirements are met through specific data protection legislation in the employment context, which is either quite comprehensive (eg. Finland) or regulates particular issues (eg. health legislation in Denmark and the Netherlands).

(9) The structure of the Advisory Committee on Safety, Hygiene and Health Protection at Work should be retained with changes made to streamline its operation and with a clear statement of the horizontal nature of its competences to cover all public and private sectors of activity in accordance with the scope of Community legislation on health and safety at work.

The EU food legislation can be based on various provisions of the EC Treaty: Article 95 in the case of measures for the completion of or the functioning of the Internal Market (taking as a basis a high level of consumer and health protection), Article 152 for measures in the veterinary and phyto-sanitary fields which have as their direct objective the protection of public health, Article 153 relating to consumer protection and Article 37 where agricultural aspects are preponderant.

Whereas Member States' legislative systems covering safety and health at the work place differ widely and need to be improved; whereas national provisions on the subject, which often include technical specifications and/or self-regulatory standards, may result in different levels of safety and health protection and allow competition at the expense of safety and health;
