The European Group for Private International Law suggested Article 4 (3) should contain a specific rule on short-term holiday tenancy, along the lines of the second subparagraph of Article 22 of the Brussels I Regulation. The wording could be the following: "However, contracts which have as their object tenancies of immovable property concluded for a temporary private use for a maximum period of six consecutive months will be governed by the laws of the country in which the lessor is domiciled, provided that the tenant is a natural person and that the landlord and the tenant are domiciled in the same country".
