In the absence of information provided by the French authorities, it seemed excluded that a private shareholder under normal market conditions would have gone ahead with the alleged investment without previously examining objective and reliable studies, preferably carried out by an impartial independent investment adviser, rather than, for example, by the beneficiary enterprise, which stated, in particular, the return on capital invested, the return period on the investment and the inherent risks in absolute terms and in relation to the remuneration arrangements linked to such an investment.
En l'absence d'éléments transmis par les autorités françaises, il semblait exclu qu'un actionnaire privé dans des circonstances normales de marché eût procédé à l'investissement prétendu sans avoir examiné au préalable des études objectives et fiables effectuées de préférence par un tiers impartial conseiller en investissement, plutôt que, par exemple, l'entreprise bénéficiaire, qui montreraient, notamment, le rendement sur les capitaux investis, l'horizon de retour sur investissement et les risques intrinsèques dans l'absolu et par rapport aux modalités de rémunération liés à un tel investissement.
