39. Expresses its concern about the recent increase in the number of discriminatory laws and practices, and of acts of violence against individuals, on the basis of their sexual orientation and gender identity; encourages close monitoring of the situation of LGBTI people, including in Nigeria and Gambia, where recently introduced anti-LGBTI laws threaten the lives of sexual minorities; expresses its strong concern regarding so-called ‘anti-propaganda’ laws limiting freedom of expression and assembly, as found in Russia and Lithuania and as currently under consideration in the Kyrgyz parliament; welcomes the UNHRC resolution on combating violence and discrimination based on sexual orientation and gender identity, adopted on 26 September 2014; considers regrettable the UNHRC’s adoption of its resolution on the protection of the family on 26 June 2014, which potentially undermines the principle of universal and indivisible human rights; reaffirms its support for the continued work by the UN High Commissioner for Human Rights to promote and protect the enjoyment of all human rights by LGBTI persons, notably through statements and reports; encourages the UNHCHR to continue to fight discriminatory laws and practices;

Regrets the adoption by the United Nations Human Rights Council of its resolution A/HRC/RES/21/3 on traditional values, undermining the principle of universal and indivisible human rights, and commends the EU’s opposition to it; regrets the absence of follow-up to resolution A/HRC/RES/17/19 on ‘Human rights, sexual orientation and gender identity’, and calls on the group of states working on this issue, including South Africa, to follow up on this resolution as soon as possible; commends the work of the United Nations High Commissioner for Human Rights to promote and protect the enjoyment of all human rights by LGBTI persons, notably through statements, reports, and the new Free and Equal campaign; calls on the UN High Commissioner to continue this work, and voice strong concern regarding so-called ’anti-propaganda’ laws limiting freedom of expression and assembly;

a.Reaffirm the EU commitment to increase its focus on ESCR in EU’s external policy, including in its programming of external assistance, while also emphasizing that human rights are indivisible and interlinked, and that the strengthening of the ESCR dimension does not in any way reflect a weakening of existing commitments to Civil and Political Rights; emphasize the clear recognition of the human rights dimension in areas such as social policy, health, education, or standard of living; develop capacity building ensuring that all relevant EU and Member States staff as well as civil society actors, including social partners on the ground are informed of the international treaties related to economic, social and cultural rights, in particular those related to fundamental principles and rights at work (ILO fundamental conventions).

In 2012 the EU adopted an ambitious programme – the Strategic Framework on Human Rights and Democracy – which sets out how it intended to honour its Treaty obligation to advance democracy, the rule of law, as well as the universality and indivisibility of human rights.
