In its annual reports on monitoring the application of Community law, the Commission has regularly acknowledged the vital role played by the complainant in detecting infringements of Community law, compliance with which it ensures on the basis of, inter alia, the infringement procedure laid down by Article 226 of the Treaty establishing the European Community and Article 141 of the Treaty establishing the European Atomic Energy Community.

Where a Community trade mark court finds that a defendant has infringed or threatened to infringe a Community trade mark, it is to issue an order prohibiting the defendant from proceeding with the acts which infringed or would infringe the Community trade mark.

If the Commission considers that there may be an infringement of Community law which warrants the opening of an infringement procedure, it addresses a "letter of formal notice" to the Member State concerned, requesting it to submit its observations by a specified date (the deadline for a response is at the discretion of the Commission it is normally two months but may be one week or less).
