7 (1) The rates and duties of excise imposed by this Act or any other law relating to excise as well as the rates and duties of excise imposed by any law relating to excise or inland revenue enacted and in force since July 1, 1867 are binding on and payable by Her Majesty in respect of any goods manufactured or imported by or for Her Majesty, whether in right of Canada or a province, and whether or not the goods so manufactured or imported belonged at the time of manufacture or importation to Her Majesty, and any and all of those Acts shall be construed and interpreted as if the rates and duties of excise were and are by express words charged on and made payable by Her Majesty.
7 (1) Les taux et droits d’accise imposés par la présente loi ou toute autre loi relative à l’accise, ainsi que les taux et droits d’accise imposés par quelque loi concernant l’accise ou le revenu de l’intérieur, édictée et en vigueur depuis le 1 juillet 1867, sont obligatoires et payables par Sa Majesté à l’égard des marchandises fabriquées ou importées par ou pour Sa Majesté du chef du Canada ou d’une province, que les marchandises ainsi fabriquées ou importées aient appartenu ou non à Sa Majesté au moment de la fabrication ou de l’importation. (2) Subsection 4(1) does not apply in respect of a conference agreement if the parties to the agreement enter jointly into any contract, agreement or arrangement with any carrier in Canada for the purpose of establishing the amount to be paid by any party to the agreement to any such carrier for the inland transportation of goods for which that party has charged a through rate for the transportation of those goods.

For this purpose, due allowance in the form of adjustments was made, where applicable and justified, for differences in level of trade (estimated price difference for sales to different type of customers in the domestic market of the analogue country), transport (comprising inland freight cost in the exporting country and ocean freight for transportation to the Union), insurance (ocean insurance cost), handling, loading and ancillary costs, commissions (paid for export sales), bank charges (paid for export sales), credit costs (based on the agreed payment terms and the prevailing interest rate) and packing costs (cost of packing materials used).

to transport; whereas, furthermore, loyalty arrangements should be permitted only in accordance with rules which do not restrict unilaterally the freedom of users and consequently competition in the shipping industry, without prejudice, however, to the right of a conference to impose penalties on users who seek by improper means to evade the obligation of loyalty required in exchange for the rebates, reduced freight rates or commission granted to them by the conference; whereas users must be free to determine the undertakings to which they have recourse in respect of inland transport or quayside services not covered by the freight charge or by other charges agreed with the shipping line;

I intend, therefore, to propose to my fellow Commissioners that a statement of objections be issued which lifts the immunity from fines enjoyed by the TACA (the Transatlantic Conference Agreement, which replaces the TAA) in respect of the fixing of inland rates charged by its members.
