The European Anti-Fraud Office ('OLAF') shall be authorised to carry out on-the-spot checks and inspections on economic operators concerned directly or indirectly by such funding in accordance with the procedures laid down in Council Regulation (Euratom, EC) No 2185/96 of 11 November 1996 concerning on-the-spot checks and inspections carried out by the Commission in order to protect the European Communities' financial interests against fraud and other irregularities with a view to establishing that there has been fraud, corruption or any other illegal activity affecting the financial interests of the Union in connection with a grant agreement or decision or a contract concerning Union funding.
3. The European Anti- Fraud Office (OLAF) may carry out investigations, including on-the-spot checks and inspections, █ in accordance with the provisions and procedures laid down in Regulation (EU, Euratom) No 883/2013 of the European Parliament and of the Councilof 11 September 2013 concerning investigations conducted by the European Anti-Fraud Office (OLAF) and Council Regulation (Euratom, EC) No 2185/ 96 of 11 November 1996 concerning on-the-spot checks and inspections carried out by the Commission in order to protect the European Communities' financial interests against fraud and other irregularities with a view to establishing whether there has been fraud, corruption or any other illegal activity affecting the financial interests of the █ Union in connection with a grant agreement or grant decision or a contract █ funded under this Regulation .

Those three types of non-discriminatory inspections should cover: (a) non-discriminatory inspections carried out at place of departure before the animals are transported on long journeys between Member States and with third countries, and after the animals are unloaded from the means of transport at the place of destination when it is a slaughterhouse; (b) non-discriminatory inspections carried out during the transport; and (c) non-discriminatory inspections carried out after the completion of the transport to verify compliance with journey times and resting periods.

Those non-discriminatory inspections should be accounted for separately from non-discriminatory inspections carried out after the completion of a journey, which include checks of journey logs or printouts from navigations systems, with the sole purpose of verifying compliance with the requirements set out in paragraphs 1.4, 1.5, 1.7 and 1.8 of Section 1 of Chapter V of Annex I to Regulation (EC) No 1/2005 concerning journey times and resting periods.

(11) Appropriate measures - proportionate to the European Union's financial interests - should be taken to monitor both the effectiveness of the financial support granted and the effectiveness of the utilisation of these funds in order to prevent irregularities and fraud. The necessary steps should be taken to recover funds lost, wrongly paid or incorrectly used in accordance with Regulation (EC, Euratom) No 1605/2002, Regulation (EC, Euratom) No 2342/2002, Council Regulation (EC, Euratom) No 2988/95 of 18 December 1995 on the protection of the European Communities' financial interests , Council Regulation (EC, Euratom) No 2185/96 of 11 November 1996 concerning on-the-spot checks and inspections carried out by the Commission in order to protect the European Communities' financial interests against fraud and other irregularities and Regulation (EC) No 1073/1999 of the European Parliament and of the Council of 25 May 1999 concerning investigations conducted by the European Anti-Fraud Office (OLAF) .

Without prejudice to the audits carried out by the Court of Auditors in liaison with the competent national audit bodies or department pursuant to Article 248 of the Treaty, or any inspection carried out pursuant to point (b) of the first subparagraph of Article 279(1) of the Treaty, officials and other staff of the Commission may carry out on-the-spot checks, including sample checks, on actions financed under the Programme and in accordance with Council Regulation (Euratom, EC) No 2185/96 of 11 November 1996 concerning on-the-spot checks and inspections carried out by the Commission in order to protect the European Communities’ financial interests against fraud and other irregularities (12).

2 (a) The competent authority shall, subject to the provisions of Article 7a, ensure that an inspection in accordance with Article 6 is carried out on any ship not subject to an expanded inspection with a target factor greater than 50 in the Sirenac information system, provided that a period of at least one month has elapsed since the last inspection carried out in a port in the MOU region.
