IN-CONTEXT TRANSLATIONS

21. Welcomes the Commission’s action plan to modernise the enforcement of intellectual property rights online with regard to commercial scale infringement; highlights the importance of copyright law and related rights being respected in the digital age; considers that copyright enforcement as laid down in Directive 2004/48/EC across Member States is extremely important and that copyright and related rights are only as effective as the enforcement measures in place to protect them; highlights that the EU faces a significant number of IPR infringements and that, according to the Commission’s data, customs authorities noted more than 95 000 detention cases in 2014, while the value of the 35.5 million articles seized is estimated to be more than EUR 600 million; emphasises the role of the European Observatory on Infringements of Intellectual Property Rights to provide reliable data and objective analyses of the impacts of infringements on economic actors; calls, therefore, for an effective, sustainable, proportionate and modernised approach to the enforcement, implementation and protection of intellectual property rights online, particularly with regard to commercial-scale infringement, to be adopted; notes that in some cases copyright infringements may result from difficulty in finding legally available desired content; calls, therefore, for a wider range of user-friendly legal offers to be developed and promoted to the public;

20. to include provisions aimed at ensuring effective and adequate protection of intellectual and commercial property rights, including protection against counterfeiting and piracy, in conformity with the WTO's Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) while taking into account at the same time that any TRIPS+ agreement must not preclude the public health safeguards available to WTO members under TRIPS, as this would restrict access to affordable medicines in developing countries;

25. to provide in the FTA between the EU and CA for measures guaranteeing the necessary effective protection of intellectual and commercial property rights, including protection against counterfeiting and piracy, in accordance with the WTO Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS); in this connection, to take account of the fact that no TRIPS+ agreement should serve to rule out the public health guarantees accorded to WTO members under the TRIPS Agreement, as this would limit access to affordable medicines in developing countries;

As regards intellectual, industrial and commercial property rights (IPR), new legislation foresees the establishment of a separate institute for Intellectual Property.

3. With a view to establishing whether an intellectual property right has been infringed under national law, and in accordance with national provisions on the protection of personal data, commercial and industrial secrecy and professional and administrative confidentiality, the customs office or department which processed the application shall inform the right-holder, at his request and if known, of the names and addresses of the consignee, the consignor, the declarant or the holder of the goods and the origin and provenance of goods suspected of infringing an intellectual property right.
3.
