O. whereas Mazen Darwish, a Syrian journalist and activist and president of the Syrian Centre for Media and Freedom of Expression, has been imprisoned since 2012, as have Hani Al-Zaitani and Hussain Ghrer, for their work defending freedom of expression; whereas Mazen Darwish was reportedly subjected to severe torture and ill-treatment and on 6 May 2015 was taken to an unknown location; whereas Mazen Darwish has been awarded the 2015 UNESCO Press Freedom Prize, as well as other important international awards, such as the Preis der Lutherstädte – ‘Das unerschrockene Wort’ 2015, the Bruno-Kreisky-Preis für Verdienste um die Menschenrechte 2013, and the PEN-Pinter Prize 2014; whereas the continued imprisonment of Mazen Darwish, Hani Al-Zaitani and Hussain Ghrer is further evidence of the repressive nature of Bashar al-Assad’s regime in Syria;
O. considérant que Mazen Darwish, un journaliste et militant syrien, président du Centre syrien pour les médias et la liberté d'expression, est détenu depuis 2012, de même que Hani Al Zaitani et Hussein Ghrer, pour leurs activités de défense de la liberté d'expression; considérant que Mazen Darwish aurait été gravement torturé et maltraité et qu'il a été emmené dans un lieu inconnu le 6 mai 2015; considérant que Mazen Darwish a reçu le prix mondial de la liberté de la presse de l'Unesco, ainsi que d'autres prix internationaux prestigieux, tels que le Preis der Lutherstädte – "Das unerschrockene Wort" en 2015, le prix Bruno-Kreisky pour une action remarquable dans le domaine des droits de l'homme en 2013 et le prix PEN Pinter en 2014; considérant que la poursuite de la détention de Mazen Darwish, de Hani Al Zaitani et de Hussein Ghrer est une nouvelle preuve de la nature répressive du régime de Bachar el-Assad en Syrie;

annul the decision C(2014) 3192 final of 26 May 2014 issued in Case State aid SA.38517 (2014/NN) — Micula v Romania (ICSID arbitration award) ordering Romania to suspend any action which may lead to the execution or implementation of the award of 11 December 2013 rendered by an Arbitral Tribunal established under the auspices of the International Centre for Settlement of Investment Disputes in the case Ioan Micula, Viorel Micula and others v. Romania (ICSID Case No. ARB/05/20), as the Commission considers that the execution of the award constitutes unlawful State aid, until the Commission has taken a final decision on the compatibility of that State aid with the internal market;

The Directive does not apply to contracts governed by certain international agreements or to be awarded under the specific procedure of an international organisation. Contracts declared secret or the execution of which must be accompanied by special security measures. Public service contracts awarded on the basis of an exclusive right enjoyed under national provisions compatible with the Treaty.
La directive ne s'applique pas aux marchés régis par certains accords internationaux ou qui seront attribués en vertu d'une procédure spécifique d'une organisation internationale, aux marchés déclarés secrets ou dont l'exécution doit s'accompagner de mesures particulières de sécurité, ni aux marchés publics de services attribués sur la base d'un droit exclusif attribué en vertu de dispositions nationales compatibles avec le traité.

On the other hand, the Directive does not apply to public contracts governed by different rules and awarded pursuant to an international agreement or a particular procedure of an international organisation, or those awarded in a third country for the deployment of military forces or to conduct or support a military operation outside the European Union (EU).
En revanche, la directive n'est pas applicable aux marchés publics régis par des règles différentes en vertu d'un accord international ou par une procédure spécifique d'une organisation internationale, ni à ceux passés dans un pays tiers, en vue de déployer des forces militaires ou de conduire ou de soutenir une opération militaire menée hors de l'Union européenne (UE).

This Directive shall not apply to concessions which the contracting authority or contracting entity awards in accordance with procurement rules provided by an international organisation or international financing institution, where the concessions concerned are fully financed by that organisation or institution.
