The draft bill (if adopted) would see the establishment of a Competition Commission with responsibility for investigating and prosecuting anti-competitive practices falling under the scope of the competition bill, while the current broadcasting and telecommunications authorities would enjoy concurrent jurisdiction for matters relating to either of those distinct areas. The bill would also see the establishment of a Competition Tribunal.

As mentioned in recital 4, a number of French producers were subject to a French court proceeding into anti-competitive behaviour due to which it was considered appropriate to initiate ex officio an interim review to re-examine the injury situation of the Union industry in particular in comparison to the situation which prevailed in the investigation period of the original investigation.
