In view of the large number of exporting producers in Argentina and Indonesia, unrelated importers in the Union and Union producers involved in the investigation and in order to complete the investigation within the statutory time limits, the Commission announced in the notice of initiation that it might limit to a reasonable number the exporting producers in Argentina and Indonesia, the unrelated importers and Union producers that would be investigated by selecting a sample in accordance with Article 17 of the basic Regulation (this process is also referred to as ‘sampling’).

Notes that, according to Special Report No 2/2011, ‘there is still no independent control of the legality of investigative acts in progress, nor is there a code guaranteeing that investigative acts follow a predictable course’, notwithstanding repeated announcements made by OLAF in the past; notes, furthermore, that although there is an explicit will in the Commission's amended proposal for a Regulation amending Regulation (EC) No 1073/1999 (COM(2011)0135) to put in place a review procedure, this will not be equal to an independent control of the legality of individual investigations and is thus even weaker in this regard than the initial proposal; recalls that this is a key demand, reflected also in the case-law of the Court of Justice; therefore considers it a must to ensure such a control mechanism, not only in order to protect the rights of the persons or economic operators concerned but also to protect the rights of the investigators of OLAF from legal proceedings initiated by those persons or economic operators; also stresses the need for a clear mandate for OLAF with regard to the other institutions of the Union;

7. Expresses deep concern and condolences regarding the events that took place on 16 December 2011 in the Zhanaozen district of Kazakhstan where 16 people died and 110 others were injured; welcomes the establishment of a government commission to investigate into the events; calls on Kazakh authorities to follow through their announcement to conduct objective and transparent investigations in order to bring about reliable information of the events, to bring justice to those found responsible of abuse of office and to allow for international monitoring of the investigations; calls for unfettered access to be granted to international organisations and local civil society organisations to the region;

A. whereas the situation of NGOs in Egypt is alarming; whereas the establishment of a committee to review civil institutions and NGOs, with the aim of tightening legal control over foreign funding of civil society organisations and political foundations, was announced in October 2011 and a request was subsequently made to the Central Bank to monitor all bank transfers to and from NGOs; whereas the offices of 10 foreign-funded organisations were searched and those organisations were investigated and then banned by the Supreme Council of the Armed Forces (SCAF) on 29 December 2011; whereas on 5 February 2012 Egypt's military-led government announced that it was putting 19 American citizens and 24 others on trial as part of a criminal investigation into the foreign financing of non-profit-making organisations active in Egypt; whereas Egyptian judges are investigating alleged illegal foreign financing of pro-democracy NGOs and political foundations, and whereas 44 defendants, including 19 Americans, 14 Egyptians, five Serbs, two Germans, two Lebanese, one Jordanian and one Palestinian, have had their cases referred to the Cairo Criminal Court and ordered not to leave the country;

3. The notice of initiation of the proceedings shall announce the initiation of an investigation, indicate the scope of the investigation, the air services on the routes concerned, the countries whose governments allegedly granted the subsidies or license the air carriers allegedly engaged in unfair pricing practices and the period within which interested parties may make themselves known, present their views in writing and submit information, if such views are to be taken into account during the investigation; the notice shall also state the period within which interested parties may apply to be heard by the Commission.
3.
