21.2 (1) This Act does not apply to a foreign publisher who, after the coming into force of this Act, makes an investment in periodical publishing that has been prescribed under paragraph 15(a) of the Investment Canada Act as a specific type of business activity related to Canada’s cultural heritage or national identity and that has been reviewed under Part IV of that Act by the Minister responsible for it and for which that Minister is satisfied or is deemed to have been satisfied that the investment is likely to be of net benefit to Canada.
21.2 (1) Est également soustrait à l’application de la présente loi l’éditeur étranger qui, après l’entrée en vigueur de la présente loi, effectue au Canada, dans le domaine de l’édition de périodiques, l’investissement visant un type précis d’activité commerciale lié au patrimoine culturel du Canada ou à l’identité nationale et désigné aux termes de l’alinéa 15a) de la Loi sur Investissement Canada, dès lors que celui-ci a fait l’objet d’un examen effectué en conformité avec la partie IV de cette loi et d’un avis — réel ou présumé — du ministre chargé de l’application de la même loi selon lequel il sera vraisemblablement à l’avantage net du Canada.

(2) For the purposes of this Act, a reference in this Act or in any schedule to this Act to the Foreign Investment Review Act, chapter 46 of the Statutes of Canada, 1973-74, or any provision of that Act shall be construed as a reference to that Act or provision as it read immediately before the coming into force of section 46 of the Investment Canada Act, chapter 20 of the Statutes of Canada, 1985.
(2) Pour l’application de la présente loi, un renvoi dans celle-ci ou dans l’une de ses annexes à la Loi sur l’examen de l’investissement étranger, chapitre 46 des Statuts du Canada de 1973-74, ou à l’une de ses dispositions constitue un renvoi à cette loi ou à cette disposition dans sa version antérieure à l’entrée en vigueur de l’article 46 de la Loi sur Investissement Canada, chapitre 20 des Statuts du Canada de 1985.

2. Expects both parties to the CETA negotiations to refrain from making demands that conflict with the other partner’s domestic policy positions or parliamentary prerogatives, such as the EU’s demand for full inclusion of Canada’s provinces in procurement liberalisation, or Canada’s demand for an investment chapter establishing an investor-to-state dispute mechanism; calls on the EU, as a sign of goodwill, to drop its challenges to local content requirements under the Ontario Green Energy Act and to the Canadian Supreme Court’s August 2004 decision on the Canada Post monopoly, which is currently subject to legal proceedings;

Ms. Aitken: Mr. Chair, I think the reference is to the Investment Canada Act, and that act contains an exemption for the sale of a Crown corporation, so the sale of a Crown corporation is not subject to the Investment Canada Act by the terms of the existing Investment Canada Act.
