Notes that the Italian Constitutional Court declared in November 2002 (Case 466/2002) that the present Italian private television system operating at national level and in analogue mode has grown out of situations of simple de facto occupation of frequencies (operation of installations without concessions and authorisations), and not in relation to any desire for greater pluralism in the distribution of frequencies and proper planning of broadcasting.This de facto situation does not therefore guarantee respect for external pluralism of information, which is an essential requirement laid down by the relevant constitutional case law.In this context, given the continued existence (and aggravation) of the situation which was ruled illegal by Judgment No 420 in 1994 and of networks considered 'surplus' by the 1997 legislature, a final deadline must be set that is absolutely certain, definitive and hence absolutely binding in order to ensure compatibility with constitutional rules; notes that, nonetheless, the deadline for the reform of the audiovisual sector has not been respected and that the law for the reform of the audiovisual sector has been sent back by the President of the Republic for a new examination by the Parliament due to the non-respect of the principles declared by the Constitutional Court ;

In the light of the European Council Thessaloniki conclusions, which “took note of the Commission's intention to launch an initiative in cooperation with the European Investment Bank to support growth and integration by increasing overall investment and private sector involvement in TENs and major RD projects and in this context invites the Italian Presidency to pursue this further”, and in the light of the Programme of the Italian Presidency for the Ecofin, the Council invites the Commission in cooperation with the EIB, inter alia taking into account the work of the high level group on transport TENs chaired by Karel Van Miert, to conduct a needs assessment and make proposals for a programme to support growth and integration by improving and/or increasing the overall investment and private sector involvement in TENs and RD projects. The Council mandates the EFC to prepare an assessment of this analysis, paying particular attention to the following aspects:

STEEL Restructuring of the steel industry Following the discussion held after the presentation by Commissioners Van Miert and Bangemann of the Commission communication entitled "Relaunching the restructuring of the Community steel industry", the Council: - confirmed the minimum target for the restructuring plan, set at 19 million tonnes of production capacity to be shed, which the industry was committed to honouring; - called on the Commission to press ahead with implementing the restructuring plan, with most delegations supporting the Commission's approach, as regards the Italian private-sector industry, of applying Article 4(2) of the Aid Code under the conditions outlined by the Commission in its document and expanded upon during the discussion.
SIDERURGIE Restructuration de l'industrie sidérurgique Le Conseil, à l'issue du débat intervenu suite à la présentation par les Commissaires Van Miert et Bangemann de la Communication de leur Institution intitulée "Relancer la restructuration sidérurgique communautaire" - a confirmé l'objectif minimal du plan de restructuration fixé à 19 millions de tonnes de réduction de capacités de production, dont la réalisation engage la responsabilité de l'industrie, - a invité la Commission à poursuivre activement la mise en oeuvre du plan de restructuration, et dans ce contexte, la majorité des Etats membres ont apporté leur appui à l'approche préconisée par cette Institution, en ce qui concerne l'industrie privée italienne, visant à une application de l'article 4.2 du Code des Aides sous les conditions énoncées par la Commission dans son document et complétées au cours du débat.
