IN-CONTEXT TRANSLATIONS

By their seventh ground of appeal, the appellants submit that the General Court erred in law in paragraph 134 of its judgment when it ruled that Article 23(2)(d) of Regulation No 267/2012 (the criterion at issue) is compatible with the principles of the rule of law and more generally with EU law, since it is ‘neither arbitrary nor discretionary’, and, in paragraph 140 of its judgment, that ‘the criterion at issue limits the Council’s discretion, by establishing objective criteria, and guarantees the degree of foreseeability required by EU law’. In that regard, the appellants submit that the General Court erred in law by interpreting the criterion at issue by reference to the judgment of 13 March 2012 in Melli Bank v Council (C-380/09 P).
Au titre du septième moyen, les requérantes soutiennent que le Tribunal a commis une erreur de droit, au point 134 de son arrêt, en jugeant que l’article 23, par. 2, point d), du règlement no 267/2012 (le critère litigieux) est conforme aux principes de l’État de droit et plus généralement au droit de l’Union européenne car il ne serait «pas arbitraire, ni discrétionnaire» et, au point 140 de son arrêt, que «le critère litigieux limite le pouvoir d’appréciation du Conseil, en instaurant des critères objectifs, et garantit le degré de prévisibilité requis par le droit de l’Union».À cet égard, les requérantes soutiennent que le Tribunal a commis une erreur de droit en interprétant le critère litigieux en référence à l’arrêt du 13 mars 2012 Melli Bank/Conseil (C-380/09 P).

Article 34(1) of Regulation No 44/2001 must be interpreted as meaning that neither the detailed rules for determining the amount of the sums which are the subject of the provisional and protective measures granted by a judgment in respect of which recognition and enforcement are requested, in the case where it is possible to follow the line of reasoning which led to the determination of the amount of those sums, and even where legal remedies were available which were used to challenge such methods of calculation, nor the mere invocation of serious economic consequences constitute grounds establishing the infringement of public policy of the Member State in which recognition is sought which would permit the refusal of recognition and enforcement in that Member State of such a judgment given in another Member State.
L’article 34, point 1, du règlement no 44/2001 doit être interprété en ce sens que ni les modalités de détermination du montant des sommes, sur lesquelles portent les mesures provisoires et conservatoires prononcées par une décision dont la reconnaissance et l’exécution sont demandées, lorsqu’il est possible de suivre le cheminement du raisonnement ayant conduit à la détermination du montant desdites sommes, et alors même que des voies de recours étaient ouvertes et ont été exercées pour contester de telles modalités de calcul, ni la simple invocation de conséquences économiques graves ne constituent des motifs établissant la violation de l’ordre public de l’État membre requis permettant de refuser la reconnaissance et l’exécution, dans cet État membre, d’une telle décision rendue dans un autre État membre.

In the light of the parallelism between the Brussels and the Lugano Convention regimes on jurisdiction and on recognition and enforcement of judgments in civil and commercial matters, the rules of the Lugano Convention should be aligned with the rules of Regulation (EC) No 44/2001 in order to achieve the same level of circulation of judgments between the EU Member States and the EFTA States concerned.
Eu égard au parallélisme qui existe entre les régimes instaurés par les conventions de Bruxelles et de Lugano pour la compétence judiciaire et pour la reconnaissance et l’exécution des décisions en matière civile et commerciale, il convient d’aligner les dispositions de la seconde convention sur celles du règlement (CE) no 44/2001, afin d’atteindre le même degré de circulation des décisions judiciaires entre les États membres de l’Union européenne et les pays de l’AELE concernés.

Section 34 (1) Upon application by the plaintiff, in a judgment on a media offence, a ruling shall be made for publication of those parts of the judgment which have to be notified in order to inform the public about the offence and conviction. The parts of the judgment to be published shall be cited in the judgment itself.
