(31) Since the objective of the proposed action, namely the creation of a fully operational internal electricity market, in which fair competition prevails, cannot be sufficiently achieved by the Member States and can therefore, by reason of the scale and effects of the action, be better achieved at Community level, the Community may adopt measures in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.
(31) Étant donné que l'objectif de l'action envisagée, à savoir la création d'un marché intérieur de l'électricité pleinement opérationnel et dans lequel une concurrence loyale existe, ne peut pas être réalisé de manière suffisante par les États membres et peut donc, en raison de la dimension et des effets de l'action, être mieux réalisé au niveau communautaire, la Communauté peut prendre des mesures conformément au principe de subsidiarité consacré à l'article 5 du traité.

The prevailing view, I think, is that the liberalisation of the internal market in electricity and natural gas is: one, way behind schedule and is being systematically obstructed by monopoly interests on the part of the private sector, the trades union and the national governments, and not just in France; two, that there are huge differences from one country to another. For example, Great Britain has fully liberalised, while France is doing exactly the opposite and the same applies, unfortunately, to my own country; three, as a result of the foregoing, there are serious disruptions in the working of the internal market, competition is being distorted and, consequently, prices are being squeezed at the expense of competitiveness both in the energy production sector and between European companies and in the consumer sector and, four, this delay is hampering cross-border transactions on these markets.
Selon un constat que j’estime général, premièrement, l’ouverture du marché intérieur de l’électricité et du gaz naturel accuse un grave retard et est systématiquement entravée par d’énormes intérêts monopolistiques, privés, syndicaux et étatiques, et pas seulement en France ; deuxièmement, l’on observe de très grandes différences d’un pays à l’autre, la Grande-Bretagne ayant procédé, par exemple, à une libéralisation complète alors que la France fait l’inverse et que c’est malheureusement aussi le cas de mon pays, la Grèce ; troisièmement, il s’ensuit que l’on constate de graves dysfonctionnements du marché intérieur et que la concurrence est contrariée, tout comme l’est, par conséquent, la réduction des prix au profit de la compétitivité tant dans le domaine de la production d’énergie que dans celui des entreprises et de la consommation ; quatrièmement, ce retard entrave le fonctionnement transfrontalier de ces marchés.

According to established case-law, the relevant geographic market comprises an area in which the undertakings concerned are involved in the supply and demand of the relevant products or services, in which area the conditions of competition are similar or sufficiently homogeneous and which can be distinguished from neighbouring areas in which the prevailing conditions of competition are appreciably different(40).
