Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. The codes should be used, as required, for each substance specified, but it should be noted that not all fourth character codes are applicable to all substances. Identification of the psychoactive substance should be based on as many sources of information as possible. These include self-report data, analysis of blood and other body fluids, characteristic physical and psychological symptoms, clinical signs and behaviour, and other evidence such as a drug being in the patient's possession or reports from informed third parties. Many drug users take more than one type of psychoactive substance. The main diagnosis should be classified, whenever possible, according to the substance or class of substances that has caused or contributed most to the presenting clinical syndrome. Other diagnoses should be coded when other psychoactive substances have been taken in intoxicating amounts (common fourth character .0) or to the extent of causing harm (common fourth character .1), dependence (common fourth character .2) or other disorders (common fourth character .3-.9). To address this problem the EU, with Senegal and Gabon, will propose the inclusion of African rosewood species into CITES Appendix II, for species that are not necessarily now threatened with extinction but that may become so unless trade is closely controlled.

With regard to the claims for the Tribunal, first, to order the applicant’s post to be regraded to a grade corresponding to the level of his responsibilities and, secondly, to order the EEAS to bear all the consequences, in particular the financial consequences, of that regrading, retrospectively from the time of his entry into the service, it should be noted that, in the context of an action brought under Article 91 of the Staff Regulations, the court may not, without encroaching upon the powers of the administration, make declarations or findings of principle, or issue directions to an institution (see order in Caminiti v Commission, F‑71/09, EU:F:2011:53, paragraph 23 and the case-law cited therein).

In that regard, the applicant claims that, by virtue of the principle and provisions cited above, when the OIE recognised certain Member States of the European Union — Italy included — as countries with a negligible BSE risk (namely, May 2008, May 2011, May 2012 and May 2013), the Commission was required to update its legislation in the light of that new information and to review the derogation provided for in point 2 of Annex V to Regulation No 999/2001 in order to ensure observance of the principle of non-discrimination: first, the derogation in question treats differently similar situations: that of producers in Member States and that of producers in third countries which have been recognised as countries with a negligible BSE risk.

In that regard, the Civil Service Tribunal took the view that while the examiners marking the written tests, in contrast to the members of the selection board sitting in the oral phase, may admittedly not be known to the persons concerned, and are thereby protected from interference and pressures to which the judgment in Parliament v Innamorati, paragraph 16 above, refers, that circumstance does not objectively justify the existence of significant differences between the requirements concerning the statement of reasons in the case of failure in the written phase, as those requirements are formulated in the case-law cited in paragraph 39 of the judgment under appeal, and those advocated by the Commission in the case of failure in the oral test, which, in particular in the instant case, would consist in giving the applicant only his eliminatory individual mark.
