In this judgment the Court declared that by failing to guarantee recognition of the rights acquired by former foreign language assistants who became linguistic associates, even though such recognition is guaranteed to all national workers, Italy had failed to fulfil its obligations under Treaty provisions on the right of freedom of movement for workers (ex-article 48 of the EC Treaty, now article 39 EC) .
