If a national authority finds that new vehicles, systems, components or separate technical units, albeit in compliance with the applicable requirements or properly marked, present a serious risk to road safety, seriously harm the environment or public health or, for tractors, present a serious risk to occupational safety, that national authority may, for a maximum period of six months, refuse to register such vehicles or to permit the sale or entry into service in its territory of such vehicles, components or separate technical units.

Once the system is operational and alerts are included in it, the SIS II will only be possible to store the following information on persons for whom an alert has been issued: surname(s) and forename(s), name(s) at birth, aliases, specific physical characteristics, place and date of birth, sex, photographs, fingerprints, nationality(ies), whether the person concerned is armed, violent or has escaped, reason for the alert, authority issuing the alert, a reference to the decision giving rise to the alert and link(s) to other alerts issued in SIS II. It will also include the action to be taken in the event that there is a “hit” (i.e. if a competent national authority finds an alert in SIS II concerning a non-EU national on whom they have carried out a check).

Points out that both the EU and Russia have a common interest in multilateral solutions to global issues; recalls that mutual trust and understanding should be the basis of an effective long-term partnership; stresses that both parties have to support the role and initiatives of the United Nations to find a compromise solution for the status of Kosovo which would ensure peace and stability in the whole region; welcomes the approach by Russia in the six-nation talks with North Korea and appeals to Russia to show a similar approach in finding a solution to the developments in Iran, Iraq and Central Asia;

If national courts find that the criteria are not met, the aid has to be considered as non notified aid with all the consequences that may entail, including recovery from beneficiaries.
