G. whereas on 4 June 2013 the North Cairo Criminal Court condemned 43 Egyptian and foreign staff members of five international NGOs (Freedom House, the International Republican Institute, the National Democratic Institute, the International Centre for Journalists and the Konrad Adenauer Foundation) to one to five years in prison for ‘managing unlicensed branches’ of their organisations, ‘conducting research, political trainings, surveys and workshops without licenses’, ‘training political parties and groups’ and ‘illegally receiving foreign funding’; whereas the court also ordered the confiscation of funds and the closure of the Egypt-based branches of those NGOs; whereas the case was initiated under the previous military-led government in late 2011;

Notes that in February 2010, before the Executive Director of the Agency was directly involved with Earthwatch, training was contracted for 29 staff members of the Agency, including the Executive Director, who went for up to 10 days of research on different biodiversity projects in the Caribbean or Mediterranean managed by Earthwatch and that the Agency paid a total of EUR 33 791,28 to the NGO, as stated by the Executive Director of the Agency; further notes that the Court of Auditors' final report for 2010 contained no findings about any conflict of interest in this connection;

Is seriously concerned that in 2010, while the Executive Director was directly involved with Earthwatch, 29 staff members of the Agency, including the Executive Director, went for up to 10 days of research on different biodiversity projects in the Caribbean or Mediterranean managed by Earthwatch and that the Agency paid a total of EUR 33 791,28, to the NGO as stated by the Agency's Executive Director;

Notes that in March 2010 a German NGO turned to the European Ombudsman, complaining that the Authority did not adequately address a potential conflict of interest concerning the move of its Head of Genetically Modified Organisms Unit to a biotechnology company in 2008 less than two months after the staff member in question left the Authority, without a ‘cooling off’ period;
