The particular issue there is the ability to get technical documentation without the permit required to send that technical documentation from the U.S. to other countries where contracts don't have the degree of urgency that would cause the problem because they couldn't get the permit in time to obtain the technical data and respond in a timely way to a bid. If that's not the issue, then there's still cross-border opportunity, but I definitely don't mean to diminish the seriousness of the problem.

As regards the fact that the ground for refusal covers any sign consisting ‘exclusively’ of the shape of goods which is necessary to obtain a technical result, the Court finds that that condition is fulfilled when, as in the present case, all the essential characteristics of a shape perform a technical function, the presence of one or more minor arbitrary elements with no technical function being irrelevant in that context.
