Only Germany objects to the Framework on grounds including the administrative burden, the treatment of capital-intensive investments, the deterrent effect on inward investment and the division of competencies between the Commission and Member States in the field of regional policy. None of these arguments are acceptable. In particular, the Framework does not affect the Commission's margin of appreciation pursuant to Article 93(2) of the EC Treaty. It follows from the principle of equal treatment of all Member States that the Framework must be applied in all Member States from its date of entry into force.
