1. The objective of this Regulation is to establish the common rules of the air and operational provisions regarding services and procedures in air navigation that shall be applicable to general air traffic within the scope of Regulation (EC) No 551/2004.

To this end, standardised rules of the air and related operational provisions regarding services and procedures in air navigation should be established, and be supplemented, where appropriate, with guidance material and/or acceptable means of compliance.

107 (1) Where, under any law of a country other than Canada, provision is made for the payment of old age or other benefits including survivors’ or disability benefits, the Minister may, on behalf of the Government of Canada, on such terms and conditions as may be approved by the Governor in Council, enter into an agreement with the government of that country for the making of reciprocal arrangements relating to the administration or operation of that law and of this Act, including, without restricting the generality of the foregoing, arrangements relating to

(a) by operation of any law governing the partnership arrangement, the liability of the member as a member of the partnership is limited (except by operation of a provision of a statute of Canada or a province that limits the member’s liability only for debts, obligations and liabilities of the partnership, or any member of the partnership, arising from negligent acts or omissions, from misconduct or from fault of another member of the partnership or an employee, an agent or a representative of the partnership in the course of the partnership business while the partnership is a limited liability partnership);

If an airport operator or a director, employee, trustee, agent, etc. of the airport operator contravenes any provision of the bill, or any direction, order, or approval made or given under the bill, or any provision of the operator’s by-laws, the Minister may apply to a court of competent jurisdiction for an order directing the individual or entity to comply with it, or restraining any such individual or entity from acting in breach of it, and on the application the court may so order and make any further order that it thinks fit (clause 245).
En cas de contravention, par l’exploitant d’aéroport – ou notamment l’un ou l’autre de ses administrateurs, dirigeants, employés, mandataires ou fiduciaires –, au projet de loi, à tout ordre, décret, arrêté pris ou agrément donné sous le régime du projet de loi ou à ses propres règlements administratifs, le Ministre peut demander à toute juridiction compétente d’ordonner à ces personnes physiques ou entités de s’y conformer. Si elle acquiesce à la demande, la juridiction peut rendre toute autre ordonnance qu’elle juge indiquée (art. 245).
