Fifth plea in law, alleging (i) infringement of the requirement that pleadings are to be construed in accordance with their actual terms and of Article 50(1)(e) of the Rules of Procedure of the CST, in that the CST took the view, in paragraph 82 of its order, that the plea of illegality raised by the appellant was not supported by any arguments, contrary to the requirements of that provision, and was therefore manifestly inadmissible; and (ii) illegality as a consequence of paragraphs 54 to 57 of the order under appeal.

Fourth plea in law, alleging (i) infringement of the requirement that pleadings are to be construed in accordance with their actual terms and of the principle that actions are to be assessed on the basis of the information existing at the time the contested measure was adopted, in that the CST took the view, in paragraph 77 of its order, that the appellant based his arguments, derived from the principle of equal treatment, on the consequences of the contested decision and rejected them in any event on the basis of those consequences; and (ii) infringement of the obligation to state reasons, the principle that the provisions of the Staff Regulations are to be interpreted in accordance with the principle of equality and the principle of equality itself, in that the CST, in paragraphs 77 and 78 to 80 of its order, failed to respond to the requisite legal standard to the appellant’s arguments.

Member States shall ensure that investment firms authorised to execute orders on behalf of clients and/or to deal on own account and/or to receive and transmit orders, may bring about or enter into transactions with eligible counterparties without being obliged to comply with the obligations under Article 24, with the exception of paragraphs 4 and 5, Article 25, with the exception of paragraph 6, Article 27 and Article 28(1) in respect of those transactions or in respect of any ancillary service directly relating to those transactions.

In order to simplify the administration and in order to take account of the specificities of the types of ecological focus area listed in paragraph 1 and to facilitate their measurement, Member States may, when calculating the total hectares represented by the ecological focus area of the holding, make use of the conversion and/or weighting factors set out in Annex VIb. If a Member State decides to consider as ecological focus area the area under point (l) of paragraph 1 or any other area that is subject to a weighting of less than 1, the use of the weighting factors set out in Annex VIb shall be mandatory.

The ELDR Group has requested split votes on various items within the Joint Motion for a Resolution, as follows: in paragraph 7 we seek to delete the second half of the sentence in order to reinforce the imperative of enlargement; in paragraph 9 we seek to remove the last clause because we know that the Lebanese government is indeed trying to reassert control over all its territory, but is prevented from doing so by forces beyond its control; in paragraph 14 we seek to delete the reference to Nato on the grounds that all EU member states are directly concerned with this issue; in paragraph 19 we seek to delete the reference to the Observatory of Industrial Change; and in paragraph 24 we seek to focus the text on the political message needed for Feira.
