(c) where a share that was owned by a particular restricted financial institution on December 15, 1987 has, by one or more transactions between related restricted financial institutions, been transferred to another restricted financial institution, the share shall be deemed to have been acquired by the other restricted financial institution before that date and after June 28, 1982 unless at any particular time after December 15, 1987 and before the share was transferred to the other restricted financial institution the share was owned by a shareholder who, at that particular time, was a person other than a restricted financial institution related to the other restricted financial institution; and

(ii) if the particular reporting period begins after June 2010, all amounts, each of which is an amount determined by the following formula in respect of tax under any of subsection 165(1) and sections 212 and 218 of the Act that became payable by the financial institution during the particular reporting period or that was paid by the financial institution without having become payable during the particular reporting period — provided that the tax is in respect of a supply or importation of property (other than real property) that is in whole or in part delivered or made available during another reporting period of the financial institution that begins before July 1, 2010 and ends on or after that day, in respect of a supply of real property the ownership or possession of which is transferred during the other reporting period or in respect of a service that is rendered in whole or in part during the other reporting period — or in respect of tax that became payable under section 218.01 of the Act by the financial institution during the particular reporting period, or that was paid by the financial institution without having become payable during the particular reporting period, and that is determined for a specified year of the financial institution that begins before July 1, 2010 and ends on or after that day:

In order to overcome potential legal impediments to providing financial support within a group of institutions, Member States shall ensure that a parent institution in a Member State, or a Union parent institution, or a company referred to in points (c) and (d) of Article 1and its subsidiaries in other Member States or third countries that are institutions or financial institutions covered by the supervision of the parent undertaking, shall establish arrangements, for the purposes of this Directive, setting out whether or not they have entered into an agreement to provide financial support to any other party in the group to the agreement that experiences financial difficulties, and demonstrating how the conditions laid down in this chapter are satisfied.

(13) holdings in other credit institutions or in financial institutions of up to 10% of their capital and holdings in insurance or reinsurance undertakings of up to 20% of their capital, as well as subordinated claims and instruments referred to in Article 35 which a credit institution holds in respect of other credit institutions or financial institutions in which it has holdings exceeding 10% of the capital in each case and subordinated claims and instruments referred to in Article 16(1), second subparagraph, point 1, 7th and 8th indent, of Directive 73/239/EEC and Article 18, second subparagraph, point 1, 5th and 6th indent, of Directive 79/267/EEC, which a credit institution holds in respect of insurance and reinsurance undertakings, amounting to the total sum of these holdings, subordinated claims and instruments which exceed 10% of the credit institution's own funds calculated before the deduction of the components referred to in point (12) and this point.

However, they should be made subject to supplementary supervision if they engage in financial commitments towards other financial institutions. For this reason, the directive should be amended accordingly.
Néanmoins, lorsqu'elles contractent des engagements financiers vis-à-vis d'autres institutions, elles devraient être soumises à une surveillance complémentaire, c'est pourquoi la directive devrait être modifiée en ce sens.
