3. Three measures have already been adopted: a Directive 2010/64/EU of the European Parliament and of the Council on the right to interpretation and translation in criminal proceedings[2] in October 2010 and Directive 2012/13/EU of the European Parliament and of the Council on the right to information in criminal proceedings in May 2012[3], and Directive 2013/48/EU of the European Parliament and of the Council on the right of access to a lawyer in criminal proceedings and in European arrest warrant proceedings, and on the right to have a third party informed upon deprivation of liberty and to communicate with third persons and with consular authorities while deprived of liberty in October 2013.[4] Measures on the protection of vulnerable persons suspected or accused in criminal proceedings are presented as a package with the present initiative, together with a Directive on the strengthening of certain aspects of the presumption of innocence and of the right to be present at trial in criminal proceedings, which form part of the underlying principles of the right of fair trial.

Trois mesures ont déjà été adoptées: en octobre 2010, la directive 2010/64/UE du Parlement européen et du Conseil relative au droit à l’interprétation et à la traduction dans le cadre des procédures pénales[2]; en mai 2012, la directive 2012/13/UE du Parlement européen et du Conseil relative au droit à l’information dans le cadre des procédures pénales[3] et, en octobre 2013, la directive 2013/48/UE du Parlement européen et du Conseil relative au droit d’accès à un avocat dans le cadre des procédures pénales et des procédures relatives au mandat d’arrêt européen, au droit d'informer un tiers dès la privation de liberté et au droit des personnes privées de liberté de communiquer avec des tiers et avec les autorités consulaires[4]. Des mesures relatives à la protection des personnes vulnérables soupçonnées ou poursuivies dans le cadre de procédures pénales sont présentées sous la forme d'un paquet législatif, comprenant la présente initiative, ainsi qu’une directive portant renforcement de certains aspects de la présomption d’innocence et du droit d’assister à son procès dans le cadre des procédures pénales, qui font partie des principes fondamentaux qui sous-tendent le droit à un procès équitable.

Bankruptcy, proceedings relating to the winding-up of insolvent companies or other legal persons, judicial arrangements, compositions and analogous proceedings and actions related to such proceedings are excluded from the scope of Regulation (EU) No 1215/2012 of the European Parliament and of the Council .

considers further that, in order to frame Parliament's cooperation with national parliaments within the AFSJ, it would be worth creating a permanent forum of representatives at political level (two per Chamber + two substitutes) meeting twice a year and sharing a common workspace where all the information dealing with the AFSJ, including that of a restricted nature, could be shared in real time); considers also that the representatives of the national parliaments should be allowed to attend Parliament's proceedings at committee level and during Parliament's annual debate on the progress of the AFSJ;
considère en outre qu'il serait utile, afin de définir la collaboration entre le Parlement européen et les parlements nationaux dans l'ELSJ, d'instaurer un forum permanent où des représentants politiques (deux par chambre, plus deux suppléants) se réuniraient deux fois par an et disposeraient d'un espace de travail commun leur permettant d'échanger en temps réel toutes les informations en rapport avec l'ELSJ, y compris celles qui sont réservées à une diffusion restreinte; estime aussi que les représentants des parlements nationaux devraient avoir le droit d'assister aux délibérations des commissions du Parlement ainsi qu'au débat annuel en séance plénière sur l'état d'avancement de l'ELSJ;

The paragraph added to the existing text of Rule 121 of the Rules of Procedure of the European Parliament deals with a potential difference of opinion between the President of Parliament and the Committee on Legal Affairs on a decision concerning submitting comments and interventions by Parliament during proceedings before the Court of Justice.

This was an abuse of this Parliament's proceedings, a gross discourtesy to a distinguished guest and an event that could have had very serious consequences.
