Directive 1999/44/EC of the European Parliament and of the Council of 25 May 1999 on certain aspects of the sale of consumer goods and associated guarantees must be interpreted as precluding legislation of a Member State, such as that at issue in the main proceedings, which does not allow the national court hearing the dispute to grant of its own motion an appropriate reduction in the price of goods which are the subject of a contract of sale in the case where a consumer who is entitled to such a reduction brings proceedings which are limited to seeking only rescission of that contract and such rescission cannot be granted because the lack of conformity in those goods is minor, even though that consumer is not entitled to refine his initial application or to bring a fresh action to that end.

Stresses that it is important for the European Parliament and the other institutions to adopt an ambitious and far-reaching digital strategy with regard to the Web 2.0 tools and social networks in particular, to strengthen the link between Europe and its citizens; further considers that Parliament and the other institutions should develop an electronic governance strategy; calls for teleworking to be used where appropriate; calls on the Bureau to consider the introduction of a cloud computing system to reduce the operating costs of the computer system, improve its performance and bring greater mobility to Parliament’s work;

It must be recalled, first, in that regard that, according to settled case-law regarding appeals brought by an institution which was the defendant at first instance against a judgment in favour of an official, the admissibility of the appeal is subject to the existence of a legal interest in bringing the proceedings, which presupposes that the appeal must be liable, if successful, to procure an advantage to the party bringing it (Case C‑174/99 P Parliament v Richard [2000] ECR I‑6189, paragraph 33, and Case C‑277/01 P Parliament v Samper [2003] ECR I‑3019, paragraph 28).
