IN-CONTEXT TRANSLATIONS

1. Capitalised management costs and fees to be reimbursed as eligible expenditure in accordance with Article 42(2) of Regulation (EU) No 1303/2013 shall be calculated at the end of the eligibility period as the total of discounted management costs and fees to be paid after the eligibility period for the period laid down in Article 42(2) of that Regulation, and in accordance with the relevant funding agreements.

In the case of equity-based instruments and micro-credit, capitalised management costs or fees due to be paid for a period not exceeding 6 years after the eligibility period laid down in Article 55(2), in respect of investments in final recipients which occurred within that eligibility period, which cannot be covered by Articles 38 or 39 , may be considered as eligible expenditure when paid into an escrow account specifically set up for that purpose.

Without prejudice to the criteria for certain contaminants levels laid down in Commission Regulation (EC) No 1881/2006 of 19 December 2006 setting maximum levels for certain contaminants in foodstuffs, the microbiological criteria laid down in Commission Regulation (EC) No 2073/2005 of 15 November 2005 on microbiological criteria for foodstuffs shall apply to milk-based drinks intended for young children currently on the market during the transition period laid down in paragraph 1.

Without prejudice to the powers of the Commission pursuant to Article 258 TFEU, where a competent authority does not comply with the decision of the Authority referred to in paragraph 3 within the period laid down in that decision, the Authority may, where the relevant requirements laid down in the legislative acts referred to in Article 1(2) including in regulatory technical standards and implementing technical standards adopted in accordance with those acts are directly applicable to financial institutions, adopt an individual decision addressed to a financial institution requiring the necessary action to comply with its obligations under that legislation, including the cessation of any practice.
4. Sans préjudice des compétences dévolues à la Commission au titre de l’article 258 du traité sur le fonctionnement de l’Union européenne, si une autorité compétente ne se conforme pas à la décision de l’Autorité visée au paragraphe 3 dans le délai imparti par ladite décision, l’Autorité peut, lorsque les exigences concernées figurant dans les actes législatifs visés à l’article 1er, paragraphe 2, y compris les normes techniques de réglementation et d’exécution adoptées conformément auxdits actes, sont directement applicables aux établissements financiers, adopter à l’égard d’un établissement financier une décision individuelle lui imposant de prendre les mesures nécessaires pour respecter les obligations qui lui incombent en vertu de ladite législation, notamment la cessation d’une pratique.

It should also be laid down that the information and estimates which result from the measures undertaken and are held by the Commission be made available to the Member States, and the European Parliament and the Council should be informed by means of an interim and a final report of the conditions for implementation of the remote-sensing measures undertaken and on the use of the resources made available to the Commission, accompanied, where appropriate, by a proposal to continue these measures beyond the period laid down in this Regulation,

22 For its part, the Commission does not accept that the Court of First Instance was bound to inform the appellants, before expiry of the period laid down by Community law for the bringing of an action for annulment, that the first application signed by two Turkish lawyers did not comply with the formal requirements laid down in Articles 19 and 21 of the Statute of the Court of Justice and contends accordingly that the action had not properly been brought before the Court of First Instance.

3. The periods laid down in paragraphs 1 and 2 shall be extended by six months in the case where Article 36 of Regulation (EC) No ./. applies. In that case, the duration of the period laid down in paragraph 1 of this Article may be extended only once.
