Recommended Union position: Amendments to Articles 2 and 9 to be supported as they clarify the roles of the keeper and of the entity in charge of maintenance in line with Union law (Directive 2008/110/EC of the European Parliament and of the Council (2)).However, the proposed amendment to Article 7 submitted by France concerning the liability of the person who has provided a vehicle for use as a means of transport in case of damage resulting from a defect of the vehicle needs further analysis within the Union before taking a decision in OTIF.

La modification proposée par la France pour l'article 7, concernant la responsabilité, en cas de dommage résultant d'un défaut du véhicule, de la personne qui a fourni un véhicule en vue de son utilisation pour le transport, nécessite toutefois une analyse plus approfondie au sein de l'Union avant une prise de décision par l'OTIF.

Given the value (approximately 60 million Euros) and the long life (8-12 years) of current such bottle fleets in the EU, the EP first reading position (amendments 124 and 223) should be supported to exempt such bottles from the nutrition labelling requirements.

Then, this summer, came the air disasters of which you are aware and to which Mr Pafilis referred, and it was at that point that Parliament, presented with this amended proposal for a regulation, adopted, at the proposal of Mrs De Veyrac as rapporteur, some extremely positive amendments harmonising the criteria under which a company can be banned or have its flight options restricted. I think that this proposal can now be adopted fairly rapidly, in November.

Pafilis rappelle et, à ce moment là en effet, le Parlement, saisi de cette proposition modifiée du règlement, a adopté, sur la proposition de Mme De Veyrac, rapporteur, des amendements extrêmement positifs qui harmonisent les critères selon lesquels une compagnie est interdite ou se voit limitée dans ses possibilités de vol. Je pense que cette proposition pourra désormais être adoptée assez rapidement, au mois de novembre.

These measures were subsequently extended and amended by Common Position 2000/346/CFSP (3), repealed and replaced by Common Position 2003/297/CFSP (4), and then renewed by Common Position 2004/423/CFSP (5), reinforced by Common Position 2004/730/CFSP (6), amended by Common Position 2005/149/CFSP (7) and extended and amended by Common Position 2005/340/CFSP (8).
