whereas following the entry into force of the Treaty of Lisbon the Commission confirmed its 2000 proposal (3); whereas in order to accelerate the procedure and allow the Council to formally transpose its political conclusions of 4 December 2009 into a Council position, which would be the next step in the ordinary legislative procedure, Parliament in its resolution of 5 May 2010 on the consequences of the entry into force of the Treaty of Lisbon for ongoing interinstitutional decision-making procedures (COM(2009)0665) – ‘omnibus’ (4) confirmed its 2002 position as its first-reading position; whereas the Council has not transposed its conclusions into a position and, accordingly, no further work on the EU patent can be carried out on the basis of the 2000 Commission proposal,

It is appropriate, in order to ensure an effective decision-making process, to examine questions relating to the preparation of a position to be taken by the Community in committees, working groups and panels established by or under international agreements dealing with customs legislation.

Measures taken include legislation on gender balance in decision-making bodies from the Parliamentary level down to regional committees, positive action to increase the number of women in higher positions, enforcement mechanisms such as equal treatment offices, information campaigns and training, and Member States have allocated financial resources to promote their policies.

Whereas a careful examination of the present situation and of the study presented by Spain gives, on the other hand, sufficient indication that a serious disturbance of the internal transport market is likely to occur in Spain if a certain period is not allowed for the effective implementation of the abovementioned agreements and regulations including the special register; whereas the market is such that there are a large number of ports with relatively small capacity and installations but that Spain's geographical position makes it an attractive market for cabotage on both Atlantic and Mediterranean routes; that a combination of these factors means that there is likely to be a further increase in the alreday existing serious excess of supply over demand which will pose a serious threat to the financial stability of the Spanish cabotage fleet; whereas, however, the new Spanish legislation is likely to begin to improve the competitive position of the Spanish fleet within the near future;
